Business Endless Mobile Plan Terms

Introduction

  1. These Business Endless Mobile Plan Terms are one of our Plan and Product Terms and apply when you sign up for or use the Business Endless Mobile Plan. They also apply to any use of the Business Endless Mobile Plan by your staff or anyone else you have authorised. If anyone in your business will be using the Business Endless Mobile Plan, please ensure they have also read and understood these terms. Our Business General Terms and Business Mobile and Wireless Terms will also apply to these products and services.

Endless Data

  1. You'll get Endless Data for use within NZ on your mobile only. Endless Data means that, you'll have an allowance of data each billing cycle to use at the maximum available speed ("Max Speed Data Allowance"), after which you'll still be able to use mobile data but your mobile data speed will be reduced to a maximum of 1.2Mbps. You'll still be able to use mobile data but you'll experience some degradation when watching video, streaming or loading images, such as lower video resolution or longer load times.

Unlimited data (on eligible plans only)

  1. Unlimited New Zealand data means you can browse the web, stream content, upload, download and play games using your max speed data. A fair use policy applies to our unlimited data. This means you cannot use the service in a way that is overly excessive or unreasonable.

Unlimited Calls & SMS

  1. You get unlimited calls and SMS to standard NZ and Australian numbers (you need to be texting another person). Excludes premium and special numbers and roaming. MMS (e.g. picture messaging) and non-data video calling excluded.

Sharing

  1. Business Endless Mobile Plans are stand-alone plans, so no sharers can be added to them and your plan allocations can't otherwise be shared with other users

Hotspot

  1. If you use Hotspot as an extra or as part of your plan, it counts towards your total data usage on your Endless Mobile plan. After max speed data allocation is used, speeds will reduce to a maximum of 1.2Mbps; this will impact your experience. Only one hotspot extra can be added per line per month.
  2. For unlimited hotspot (on eligible plans only), data is at max speed. A fair use policy applies. This means you cannot use the service in a way that is overly excessive or unreasonable.

Prohibited Usage

  1. Machine to machine services, tethering or mobile hotspots (unless you've added Hotspot extra or if Hotspot data is included in your plan) or any other similar activity that Spark considers to be non-standard usage is prohibited ("Prohibited Usage"). If we consider you are engaging in Prohibited Usage we may ask you to stop such usage and if it continues, remove your subscription immediately with notice.

Network Management

  1. Service may be slowed, suspended, terminated, or restricted for misuse or interference with our network. Spark reserves the right to remove the offer or the plan from the market (and recommend migration to the best alternative plan) in accordance with our standard terms.

Fair Use

  1. A fair use policy applies to some Endless Mobile plans. This means you cannot use the service in a way that is overly excessive or unreasonable. This policy is based on how most people use the service and helps us make sure everyone using it gets to enjoy it. If you engage in overly excessive or unreasonable usage we will contact you. If this usage continues, you will be given the choice to move to a new plan.

Plan Changes

  1. We may update the Business Endless Mobile plans, applicable inclusions and offers, or stop selling or providing these plans (and migrate or recommend migration to the best alternative plans) in accordance with the Business General Terms.

Plan Transfer

  1. If you're on a 24-month term plan and want to move to an open term plan, including a Business Endless Mobile plan, you'll have to pay any applicable disconnection fees. Refer to our Schedule of Disconnection Fees and Termination Charges

Devices

  1. Business Endless Mobile Plans are for mobile phones only, and the SIM cannot be used in any other type of device, including tablets, mobile broadband dongles, hotspots, or modems. Devices are sold separately from plans.

Discounts and offers

  1. Plan may not be eligible for offers, subsidy, credits or discounts.

Frequently asked questions (FAQ)

What does Endless Data mean?

With the Spark Endless mobile plan, you will receive Unlimited talk (NZ & AUS), Unlimited SMS (NZ & AUS) and endless data (NZ only). Endless NZ data means you can browse the Web, stream content, upload, download and play games. While there are no strict data caps, after allocated data at max speed, Spark will slow data speeds for the remainder of the billing cycle to a maximum of 1.2Mbps, this will impact your experience. Tethering and mobile hotspot use is prohibited, unless you purchase a Hotspot extra or if Hotspot data is included in your plan, and it’s limited to mobile devices only.

Are there limits to what I can stream or how I can use my data?

With the Spark Endless mobile plan, you can browse the Web, stream content, upload, download and play games. After allocated data at max speed, Spark will slow data speeds for the remainder of the billing cycle to a maximum of 1.2Mbps. What this means in practice is while the customer will still be able to browse, they will experience degradation when watching video, streaming or loading images. Tethering and mobile hotspot use is prohibited, unless you purchase a Hotspot extra or if Hotspot data is included in your plan, and it’s limited to mobile devices only.

Is the Spark Endless plan compatible with tablets?

No, the Spark Endless plan is restricted for mobile use only, and cannot be used on any other device, including SIM enabled tablets, t-sticks, hotspots, or modems.

What if I put my SIM into one of your Spark wireless modem or t-stick?

The Spark Endless plan is restricted for mobile use only. Spark reserves the right to monitor data usage and customer volumes, to ensure customers are complying with terms of use. Service may be slowed, suspended, terminated, or restricted for: misuse, or interference with our network.

Can I share my Endless plan allocations: data, SMS and minutes?

The Spark Endless plan is a stand-alone plan. Spark Sharer plans cannot be added to this plan; therefore, no plan allocations can be shared with any other user. 

What if a term customer wants to transfer to the Spark Endless plan?

Pay Monthly customers who have a Minimum Term and want to move to any Open Term plan, including Spark Endless plan, will have to pay Disconnection Fees before connecting to an Open Term plan. Refer to the Schedule of Disconnection Fees and Termination Charges

Sometimes our Endless plans have other specific plan terms that apply. Please check those terms. In the event of inconsistency, the plan terms prevail.
