From 11 September 2017, we'll be making some important updates to our terms and conditions for our Business Mobile Plans customers.
If you sign up to Spark from 11 August 2017 these terms will apply.
If you signed up before 11 September 2017 and receive a letter or email from us prior to 14 September these terms will apply on your next bill cycle post this date.
These updates will describe how Share Plans will work and who is eligible:
What do I do if I am a fixed-term/in-contract customer and want to discuss my options with this change?
If you are a fixed-term customer in a current contract, message us if you wish to discuss your options.
The Business Mobile Mobile Postpaid Agreement applies in addition to the following terms and conditions.
Available only to customers registered as a Business or Home Business customer with Spark. To register as a Business you must be a Company/Legal Trading Entity or Sole Trader.
You can choose 24 month Minimum Term on the Ultra Business Mobile plans.
No fixed term contract (also known as "open term contract") is available on Business Mobile plans.
The minimum call charge for your Business Mobile plans is one minute except for operator assisted and premium numbers; after the first minute you pay per minute. Every call you make is charged at the rate applicable to your Ultra Business Mobile Plan. If there is no answer you won't be charged for the call (note, calls answered by a message service or answering machine are chargeable).
Any international calls that is not to Australia, premium number calls, operator assisted calls, directory related services, chargeable special short code numbers and Prohibited Usage.
You'll be charged the full minute rate for each minute or part minute.
You'll be charged both the premium number rate and the mobile rate for each minute or part minute.
Any number of messages may be checked per access.
Only available when you make video calls to other video calling capable Spark mobiles within New Zealand, or video-capable mobiles on a supported international mobile network in a video-capable coverage area.
Business Mobile plans come with Data Stretch.
Data Stretch provides additional mobile data for your mobile plan, once your plan data and any extras have been used.
With Data Stretch you can use up to an additional 2 GB of mobile data at $20 per GB. To keep things fair we will only charge you at casual data rates (25c per MB) for the first 80MB which equals $20.
After your Data Stretch allowance is used up, casual data rates (25c per MB) will apply.

If you are sharing mobile data from a Primary Mobile, Data Stretch will only apply to the Primary Mobile plan. Users on a sharing plan will not be eligible for their own individual Data Stretch.
The free mobile team calling on Business Mobile plans is only available to Spark Business customers. For free mobile team calling all mobiles must be on a Business Mobile plan and
must be on accounts under the same customer number. Calls diverted from one eligible mobile to another under the same customer number will be included in the free mobile team calling.
Free voicemail on Business Mobile plans is only available to Business customers. Applies to calls to voicemail while in NZ only.
Postpaid customers who have a Minimum Term and want to move to an Open Term plan, will have to pay Disconnection Fees before connecting to an Open Term plan. Postpaid customers who are on a Minimum Term wishing to change their postpaid plan to one which is lower than their current postpaid plan can do so at any time, however Transfer Charges may apply. Refer to our Schedule of Disconnection Fees and Termination Charges.
You may transfer plans only once per your billing period by calling Spark on 126.
Your billing period is the period of time you are billed for calls, texts, data and other associated costs accumulated on your account. You billing period is fixed each month. This means your billing period will roll over on the same date each month, with any included minutes, texts, data or usage refreshed on that same date. Your billing period's rollover date will not change, unless you contact Spark and ask for your bill statement date to be changed. You can find out the rollover date of your billing period from *333.
The account holder is responsible for all charges associated with the plan, including charges incurred by any users associated with that plan. Charges include the minimum monthly charges, monthly additional user charges (for each user), overage charges, extra charges and any other service charges incurred.
You can share eligible plans with other users in your account. As the user choosing to share your plan, you are the "primary mobile".
To share, all users must be on a share plan and be under the same Spark billing account as the Primary Mobile.
The users who are sharing agree that the Primary Mobile they are sharing from is authorized to view, and manage how much shared data is used by each user. Each additional mobile number added to the plan as a user will incur a monthly share user fee as set out in the pricing information for your Business Share Plan.
If you add a user to your Business Mobile Plan you authorise that user to access and use the services, and you are responsible for all use of the Business Mobile Plan of that user and all the charges they incur.
If the Primary Mobile of the plan is disconnected for any reason, another mobile number on your account must be nominated as the Primary Mobile and the same terms will apply to that mobile number.
If you do not nominate a new Primary Mobile, within 24 hours after the Primary Mobile is disconnected, Spark will select a new Primary Mobile for you from one of your existing users.
The new Primary Mobile will be put onto a plan that meets Spark’s then current business rules to allow for the number of remaining users.
The mobile user (or tablet user) who has been active on the account for the longest time will be selected..
We will notify the account holder of this change via email. If an email address hasn’t been provided as a key contact, we will notify the new lead plan via SMS.
You may contact us at any time to change the Primary Mobile.
Shared Data is the mobile data that is the primary mobile chooses to share with other users who are under the same Spark account as the the primary mobile.
Customers who choose to add users to their Account can share their mobile data, and will be able to view and manage the Shared Data of users they are sharing with.
This can be done through the My Spark portal, our website or by using the Spark Mobile App
Both the My Spark portal and the Spark Mobile App will give a view of Shared Data usage for each user that is consuming Shared Data.
Only Shared Data usage will be shown.
This may be:
Any Shared Data from the primary mobile, any Shared Data extras purchased by the primary mobile, any casual data on the primary mobile including Data Stretch if this applies to your plan. Individual usage won’t be shown here.
Usage will reset at the beginning of each bill cycle. Usage is rated from our network and near real time based off best effort.
Usage is calculated in 10KB increments and will be shown in 0.05GB increments for display purposes. Details of visited sites will not be shown as part of monitoring usage.
You can now set a maximum amount of Shared Data a user can use within a billing month. Shared Data usage is first come, first serve. Setting a limit will not mean that a user can use all of the data in their limit, as other users in the group may use up the total Shared Data before that sharer reaches their limit.
Management of Shared Data limits, and use of that data, is the responsibility of the customer. Spark will not proactively ensure the limits you have set always allow your plan to be maximised, or all the data within your plan’s allocation to be used.
Managing users: Once a user reaches their Shared Data limit, they won’t be able to use any more Shared Data for the remainder of their bill cycle
We will send a notification to the user once this happens.
The primary mobile user will need to either increase or remove the Shared Data limit so the user can continue to use data.
Alternatively a user may choose to purchase an individual data allowance if no account restrictions apply.
It will be possible for a primary mobile to stop a user from using Shared Data.
Any limit set will remain until such time as the primary mobile chooses to either remove, or change them. This includes stopping a user from using Shared Data.
Spark may change, add to or delete these terms, including adding whole new terms at any time. Any changes will be made, and notified to you, in accordance with your Mobile Postpaid Agreement.
