Wireless Broadband Terms

The following Terms apply to our customers who have a Spark Wireless Broadband service with us.  These Terms apply together with the Mobile Postpaid Agreement.  These Terms will prevail to the extent they are inconsistent with the Mobile Postpaid Agreement.

1.    Spark Wireless Broadband requires a Spark Wireless Broadband Modem which requires mains power. In the event of a power failure, service will not be available, including access to emergency services.  Make sure you have a charged mobile phone available for use in power outages including for emergencies.

2.    Spark Wireless Broadband is available in certain 4G coverage areas. 4G coverage is not available everywhere.  Spark does not guarantee that the service can be supplied at a particular location.  If the service is not available at your location or the quality of the service is not of an acceptable quality, you can return your Spark Wireless Broadband Modem to Spark within 30 days of receiving the Spark Wireless Broadband Modem for a full refund of the purchase price and first month's access fees (excludes overage charges and purchases of additional data). This return right does not impact the rights you have as a consumer customer under the Consumer Guarantees Act.

3.    Not all services are available with Spark Wireless Broadband.  If you have a monitored alarm that uses your landline, you’ll need to update it to a wireless option.  Most medical alarm providers offer wireless monitoring solutions.  It is important that you arrange this with your provider before sign-up.   Services such as faxes, the interactive features of Sky digital or PABXs are also incompatible.  A list of other incompatible services are available here

4.    You can use portable cordless phones (which are available from Spark) if you need multiple phones in your home (as this service does not use a copper connection or phone jack points in your home).

5.    If you use all your plan data, the first 10GB extra data pack will automatically be charged to your account. Once this is used up, Extra Data Packs can be purchased but limits apply as the service is not intended for heavy data users.  If you regularly require more data in excess of over 5 Extra Data Packs (ie more than 2 months in any 4 month period), we may ask you to move to another connection technology or to reduce your data usage on Wireless Broadband. If you continue to require more data in excess of the 5 Extra Data Packs a month, we reserve the right to withdraw your access to the Services by cancelling it on 30 days’ notice.

6.    You may only use your Spark Wireless Broadband Modem to receive the Spark Wireless Broadband service at the installed location.   If you use your Spark Wireless Broadband Modem at another location we reserve the right to withhold, suspend, disconnect, or restrict your Spark Wireless Broadband service without notice. The reason we retain this right is that we need to be able to manage the network to ensure that all customers using the network receive a reliable and consistent service.   If you are moving, please contact us. If you are moving within our Spark Wireless Broadband coverage area, you may be able to continue to use the service.  If not, we can confirm what other broadband options are available.  

7.    If you choose to sign up with Spark Wireless Broadband on a 12 month contract, and your service is disconnected before the completion of that minimum contract period, you will be charged an early exit fee of $199. You will not be required to pay an early termination fee if you are exercising your right to terminate your agreement with us under clauses 15.2, 15.4 or 15.8 of the Mobile Postpaid Agreement.

8.    If you sign up with Spark Wireless Broadband with no fixed term, we will send you a modem on us (a delivery charge will apply) and it’s yours while you have the service.  You agree to return the modem when you cancel your plan or a fee may apply.   If you cancel your service within 2 years, simply contact Spark to return your modem (along with the original packaging and all associated cables and other equipment originally provided to you with the Wireless Broadband Modem) in good working order. Spark will provide a prepaid courier bag for you to return your modem – please return it within 14 days of the disconnection of your Spark Wireless Broadband service.  If you choose not to return your modem, the following fees will apply:
    0-6 months         $199
    7-12 months        $149
    13-18 months    $99
    19-24 months    $49
    25+ months        $0

9.    Charging for Spark Wireless Broadband starts once your service is connected to our network. Please be aware you need to let us know 30 days in advance if you wish to cancel this service (these services). If you change or remove your plan or package within 30 days you will still be charged for the full month.

10.    Upstream and downstream speeds are based on a theoretical maximum.  Actual speeds will be affected by various factors including NZ and overseas networks, your modem and computer technology, and other environmental factors.

11.    If your Spark Wireless Broadband service is disconnected for any reason, we cannot guarantee you will be able to connect back to a fixed line broadband service, particularly if there are capacity issues in your area.  An availability check will need to be done for your address if you choose to change to another broadband technology.  If you have an existing broadband connection with another provider, you are responsible for arranging for disconnection of this service.

12.    The Spark Wireless Broadband Modem contains a SIM card. You may not use this SIM card in any other device. It remains our property and you must return it to Spark on reasonable request.

13.    Any unused data within a monthly data allocation will not be carried forward to the following month.

14.    For Home Wireless Broadband with Landline or the Wireless landline only service, local calls are included in this plan.

15.    For Rural Wireless Broadband with Landline or the Wireless landline only service, national landline calls are included in this plan. National Calling applies to direct dial voice calls from your home line to landlines in New Zealand, all calls are for up to 2 hours, after 2 hours you will be charged 24c per minute. Excludes calling cards 059, 0161, premium numbers (0900 and any International equivalent), calls made via Home 0800 or International 0800.
