1.  Our Spam Policy

In this policy:

  • "we" or "Xtra" means Xtra Limited, a subsidiary of Spark New Zealand Limited providing you our services
  • "you" means you, the person using our services, or visiting our xtra.co.nz ("Web site")
  • "services" means any of the goods, products or services of any kind we provide, including the Web sites and anything else we do

Your use of our Services after each update of this spam policy shows your unconditional agreement to the terms of this policy as set out below.

What is spam?

By "spam" we mean email often sent in bulk without regard to the recipient's wishes. Spam has the potential to flood email systems, breach the privacy of others, and lead to "flaming" or abusing of the sender.

Spam causes problems for Internet service providers and their customers. Xtra therefore prohibits spamming and other unethical marketing activities. This policy outlines some of the different types of mail and news group spam, and provides some examples of spamming activities that must not be carried out through or in connection with the Services we provide.

Email spam includes:

  • Unsolicited commercial emails: email messages advertising a product or service sent without the receiver's consent.
  • Unsolicited bulk email: email messages that are sent in bulk to many recipients. They can be unsolicited commercial emails, or email for other purposes such as political lobbying or harassment. Unsolicited bulk email can not only impact the operations system of servers, but can raise privacy concerns if it identifies other email addressees.
  • Make Money Fast: email messages often distributed in the form of chain letters or multilevel marketing or pyramid schemes, and including hoax warnings. Pyramid or chain letter schemes that involve money or valuable items and promise unrealistic returns are often illegal. If you start one or send one on, you could be breaking the law.
  • Reputation Attacks: email messages that appear to be sent from one person or organisation but are actually sent from another. They can be fraudulent or otherwise illegal.

News Group (Usenet) spam includes:

  • Excessive multi-posting: an identical article posted to many groups.
  • Excessive cross-posting: articles cross-posted to many news groups.
  • Off-topic postings: articles with inappropriate content for the news group to which they are posted. Many news groups have Frequently Asked Questions (FAQs) to help define what is on or off-topic.
  • Binaries: articles containing encoded binary files, for example, images, programs, video, or music samples. Binaries are inappropriate even if they are on-topic except for news groups that specifically allow them.
  • Commercial postings: articles advertising a product or service, whether or not they are considered on-topic. The rules on commercial postings vary between news groups, please check the FAQs of the particular news group for information as to whether it allows commercial postings.

4.  Spamming activities

The following are examples of spamming activities that are not permitted through your use of the services:

  • Using or causing to be used Xtra's services or systems to facilitate the transmission of unsolicited or unauthorised material. This includes any promotional materials, URLs, "junk mail", "chain letters", "pyramid schemes", or any other form of unauthorised solicitation that you may upload, post, email, transmit, or otherwise make available.
  • Manipulating or forging identifiers, such as email headers or domain names, to disguise the origin of any content transmitted to or through Xtra's services or systems.
  • Relaying email from a third party's mail servers without the permission of that third party, or using similar techniques to hide or obscure the source of the email.
  • Harvesting or collecting email addresses from the Xtra Web sites for purposes of sending unsolicited or unauthorised material.
  • Uploading, posting, emailing, or transmitting the same message, URL, or post multiple times.
  • Disrupting the normal flow of dialogue, or causing the screen to "scroll" faster than other users of the service are able to type, or otherwise acting in a manner that negatively affects other users' ability to engage in real-time exchanges.

Certain Services may have additional spam guidelines explaining appropriate conduct for those services. It is your responsibility to check each Service's guidelines for additional details regarding spam.

Xtra reserves the right, in its sole discretion, to identify material transmitted over the Xtra network as "spam".

Xtra reserves the right to take all legal and technical steps available to prevent spam, unsolicited bulk email or other unauthorised email from entering, utilising or remaining within the Services or Xtra network.

5.  What if I receive spam?

Xtra now provides Xtra email customers with an anti-spam filter service which gives you the tools to quickly and effectively get rid of it and take back control of your mailbox.

Please note that Xtra also filters outbound spam. The majority of spam now comes from infected computers that are being used remotely by professional spammers to send spam. So we now filter mail sent by all our customers for spam. This means that there is a very small chance that a legitimate email that you try to send could be mistakenly identified as spam, and in this case it will not be delivered. You will not be informed if your email has been deleted, so if you are sending a critical email, we recommend that you get a read receipt so you can be sure it has been delivered and read.

While it is difficult to eliminate spam from your account completely, there are procedures you can put in place for your own email use to minimise the amount of spam you receive.

6.  Changing this policy

We may, at our discretion, update or revise this policy at any time. Any changes will take effect immediately once they are posted on our Web site. It is your responsibility to check this policy regularly for any modifications or updates.
