By submitting an entry to the $15,000 Spark Business Edge Pack competition, you and your business agree to the following terms and conditions:

Eligibility

Eligible Businesses and Applications

1. Entry is open to all New Zealand businesses with less than 100 full time employees who have meet with a Spark business hub consultant or phoned Spark to discuss Spark’s business mobile, broadband, other Spark products, or has completed a transaction with the Spark Business Contact Centre (“ Eligible Business”). See paragraph 5 below for further details.

2. Entry is not open to the local branches of any nationwide franchise where that local branch purchases Spark services through its national franchise.

3. The $15,000 Spark Business Edge Pack consists of:

  • (a) $2000 of Spark Broadband - a credit of up to $2,000 to be applied to your Spark Broadband account to be used in the 24-month period commencing on the date you are advised you to have won a Spark Business Edge Prize Pack (“Credit Period”). Any amount remaining at the end of the Credit Period cannot be redeemed or transferred to any other product, user or account;
  • (b) Technology upgrade - $12,000 to upgrade your business’s information communication technology hardware or services. Funding can be applied to one of the following categories:
  • (c) Digital coaching - $1,000 worth of James Kemp business digital coaching sessions.

Promotion Period

4. The competition commences 9.00am on Monday, 2 July 2018 and closes at 5:00pm on Monday, 1 October 2018 (the “Promotion Period”). Entries received during the Promotion Period will be eligible to win one of six $15,000 Spark Business Edge Packs.

Competition Entry

5. For your business to enter the promotion you (or a colleague) must do one of the following:

  • a) Meet with a consultant at a Spark Business Hub. Book a meeting using the “book a call” form on our Spark website at https://www.spark.co.nz/business/contactus/book-a-call/; or
  • b) Call 0800 Business or 0800 287 463 or Spark Business Contact Centre to discuss a new Spark Business mobile or broadband plan or to arrange to sign a renewal of your current Spark business mobile or broadband plans or review your current account. After meeting with the Spark Business Hub consultant or calling to discuss your Spark Business mobile or broadband plan or account, complete an entry form in your business’s name and enter the draw.

6. You (or the person who enters this competition) warrants that you (or they) are authorised by the business to enter this competition in the business’s name. Spark reserves the right to disqualify your business’s entry where it reasonably suspects that you do not have the authorisation to enter this competition on behalf of the business or the entry is prohibited by these terms and conditions, any relevant law, or are otherwise deemed inappropriate. This is at Spark’s absolute discretion.

7. There is a limit of one entry per Eligible Business for the duration of Promotion Period. Spark may consider more than one entry from your business on request and provided that each entry is from a different unit within your business.

8. All entries to this competition become the property of Spark. By entering, you and your business agree that Spark is free to use your business’s entry as it sees fit, including for the purposes of this competition as well as for promotional, marketing and publicity purposes, without compensation.

9. Spark is not responsible for any lost, late or misdirected entries or for any problems or technical malfunction which may result in delay or failure to enter your business into the draw.

Judging

10. There are six $15,000 Spark Business Edge Packs to be won.

11. There will be six prize draws across New Zealand split by Auckland North, Auckland South, Bay of Plenty, Central North Island, Lower North Island, Lower South Island on 15 October 2018. Each eligible entry will have entered the relevant local region prize draw and a winner will be randomly drawn in each of the six regions.

12. Each region’s winner will be notified by phone on or around 18 October 2018. Spark will make reasonable attempts to contact each winner but if the winner is not able to be contacted within three attempts or is unable to redeem the prize in accordance with these terms and conditions, the prize will be reallocated randomly to another qualifying entry for that region. The prizes will be delivered to each region’s winner at an address agreed by the region’s winner and Spark.

13. The judges’ decision is final, and Spark will not enter correspondence regarding the result.

14. The prizes awarded in this competition must be used for the benefit of each winning business and, as applicable, towards technology upgrade projects and/or activities from Spark or Spark’s partner products as mutually agreed by each winner and Spark. Spark will work with the winning businesses to facilitate the payment for chosen technology upgrade or activity.

15. To be a recipient of the prizes each beneficiary must be a Spark Business Hub customer at the date of the draw or in discussion with Spark about signing up to a Spark agreement. To be eligible to win the $2,000 broadband credit, the beneficiary must be purchasing a Spark broadband service.

16. If your business is successful in winning a prize, your business grants to Spark the right to use the business’s name, in whole or in part and in accordance with these terms and conditions, in any media (including banners, signage, posters, television, magazine, Internet, Facebook, Instagram, MMS, DVD or other digital or print formats) for an unlimited time for any purpose. This includes but is not limited to publishing your business’s name on Spark’s website, publishing case studies about your business, media releases and promoting future promotions and grants of a similar nature.

17. Key personnel within each of the winning businesses must be willing to participate in media releases. Each winning business warrants that it has obtained the consent of all individuals mentioned, participating or otherwise providing personal information before Spark publishes the winning entry and/or releases any media or public statements. If personal information is requested or used by Spark, such personal information will be held by Spark in accordance with its privacy policy at https://www.spark.co.nz/privacypolicy/. You and any participating individuals have the right to access, update and correct such information.

18. The name of each winning business’s authorised representative on the business’s entry will remain as the sole contact for the promotion. If this person leaves the winning business, it is the winning business’s responsibility to notify Spark of the change and a replacement authorised representative.

19. The prize must be taken as stated and no compensation will be payable if any winning business is unable to use the $15,000 Spark Business Edge Pack as stated. The prizes cannot be transferred to any other business, unless agreed to by Spark, or exchanged or redeemed for cash. If a winning business is unable to satisfy these terms and conditions, within twelve months of the grant being awarded (with the exception of the 24-month broadband credit), it will be forfeited by the winner.

20. If any act, omission, event or circumstance occurs which is beyond the control of the Spark and which prevents Spark from complying with these terms and conditions, Spark will not be liable for any failure to perform or delay in performing its obligations and Spark reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.

21. To the extent permitted by law, Spark excludes any liability it may have to you or your business arising directly or indirectly out of or in connection with this promotion.

22. Spark, accepts no responsibility or liability for any additional costs or expenses that may be incurred by the prize winner in relation to the prize or the winner’s use of that prize. This includes, but is not limited to, any mentoring or advice provided by or in connection with the Digital Mentoring.

23. Spark accepts no responsibility for any tax implications that may arise from accepting a prize. Independent financial advice should be sought.
