Business Endless Data Plan Terms

Introduction

 

  1. These Business Endless Data Plan Terms are one of our Plan and Product Terms and apply when you sign up for or use the Business Endless Data Plan. In buying these services, you understand and agree to these terms. They also apply to any use of the Business Endless Data Plan by your staff or anyone else you have authorised. If anyone in your business will be using the Business Endless Data Plan, please ensure they have also read and understood these terms. Our Business General Terms and Business Mobile and Wireless Terms also apply to these products and services.

  2. In the event of inconsistency, these Business Endless Data Plan take precedence, followed by the Business Mobile and Wireless Terms then the Business General Terms.
  3. This Plan is available for Spark Business customers who already have a Business Endless Mobile plan or eligible broadband plan. Limit of one Endless Data Plan per Endless Mobile Plan or broadband plan. No sharers can be added to this plan.
     

Your data

  1. Endless Data for personal NZ use on your mobile only. Excludes Roaming data. Allocated data at max speed, then speeds reduce to 1.2Mbps, this will impact your experience. No tethering or hotspots unless you buy a Hotspot Extra. Standard NZ & Aus numbers. MMS (e.g. picture messaging) and non-data video calling excluded.

Prohibited usage
 

  1. Machine to machine services, tethering, mobile hotspots (unless you buy a Hotspot extra), or any other similar activity that Spark considers to be non-standard personal usage is prohibited (“Prohibited Usage”). If we consider you are engaging in Prohibited Usage we may ask you to stop such usage and if it continues, remove your subscription immediately with notice.

Network management

 

  1. Service may be slowed, suspended, terminated, or restricted for misuse or interference with our network. Spark reserves the right to remove the offer or the plan from the market (and recommend migration to the best alternative plan) in accordance with our Business General Terms.

Plan transfer

 

  1. Pay Monthly and broadband customers who have a minimum term and want to move to any open term plan, including the Business Endless Mobile Plan, will have to pay any applicable disconnection or early termination fees. Go to Schedule of Disconnection Fees

What does the Business Endless Data Plan include?

  • Endless Data – New Zealand data only. Allocated data at max speed, then speeds reduce to a maximum of 1.2Mbps. No tethering or hotspots, unless you buy a Hotspot extra or if Hotspot data is included in your plan.
  • Excludes: subsidy, tethering and hotspots (unless you buy a Hotspot extra).

What does Endless Data mean? 

With the Business Endless Data plan, you will receive endless data (NZ only) for your tablet or mobile broadband device. Endless NZ data means you can browse the web, stream content, upload, download and play games. While there are no caps on how much data you use, after allocated data at max speed, Spark will reduce the maximum speed for the remainder of the billing cycle to a maximum of 1.2Mbps. Tethering and mobile hotspot use is prohibited (unless a Hotspot extra is purchased) and endless data is for use on tablet or mobile broadband device only.

Who is eligible for the Spark Business Team Endless Mobile plan?

Business mobile customers who have an eligible Business Endless Mobile or broadband plan. You can add one Business Endless Data Plan per Business Endless Mobile or eligible broadband plan. For example, if you have one Business Endless Mobile Plan, you are eligible to connect one Business Endless Data Plan. If you have five Business Team Endless Mobile Plans, you will be eligible for five Business Endless Data Plans.

If you terminate your required mobile plan, Spark will contact you within ten (10) days to notify you that if you continue to have an Endless Data plan without a required mobile or broadband plan, your Endless Data Plan will be terminated.

How much is the Business Endless Mobile Plan?

We have a range of Endless Mobile plans for all business sizes. Plans for single users start at $60.87 (exc GST).

Are there any rules about what I can stream, or how I can use my data?

With the Business Endless Data plan, you can browse the Web, stream content, upload, download and play games. After allocated data at max speed, Spark will reduce the maximum speed for the remainder of the billing cycle to a maximum of 1.2Mbps. What this means in practice is while you will still be able to use your data like you did before, however you will experience some degradation (such as lower video resolution) when watching video, streaming or loading images. The actual data speed you achieve is dependent on several factors, including distance to the cell tower site.

Why does Spark exclude tethering and hotspots?

To protect the data experience for all customers on our network, the Business Endless Data Plan does not include mobile hotspot/tethering by default. You may buy a Hotspot Extra if your plan doesn't include Hotspot data.

How will you know if I’m tethering or hotspotting?

Spark reserves the right to monitor data usage and customer volumes, to ensure customers are complying with our terms of use. Service may be slowed, suspended, terminated, or restricted for misuse, or interference with our network.

Are the Business Endless Mobile plans compatible with tablets?

No, the Spark Endless Mobile plans are restricted for mobile use only, and cannot be used on any other device, including SIM enabled tablets, t-sticks, hotspots, or modems. If you want to use a connected tablet or mobile broadband device, you will need to have an Endless Data plan.

Are the Business Endless Data plans compatible with mobiles?

No, the Business Endless Data plans are restricted for tablet or mobile broadband use only, and cannot be used on any other device, including mobile phones or modems.

What if I put my Business Endless Data plan SIM into one of your Spark wireless modems, t-stick or mobile phone?

The Business Endless Data plans are restricted for tablet and mobile broadband device use only. Spark reserves the right to monitor data usage and customer volumes, to ensure customers are complying with terms of use. Service may be slowed, suspended, terminated, or restricted for: misuse, or interference with our network.

Can I share my Business Endless Data plan data?

Prohibited use of tethering and hotspots means that sharing data via these means is restricted, unless you purchase a Hotspot Extra.

Is there a Business Endless Data plan option for Term customers?

Yes, the Business Endless Data Plan is available if you are on the Business Team Endless Mobile Plan 24 Months or on selected broadband term plans such as Business Flexible 24 Month plans. These are our only term plan options available.

What if a term customer wants to transfer to the Business Endless Data Plan?

Business customers who have a minimum term and want to move to any open term plan, including Business Endless Data plan, will have to pay disconnection fees before connecting to an open term plan. Refer to our Schedule of Disconnection Fees and Transfer Charges

I'm on a Wireless Broadband plan, can I get the Endless Data plan?

Yes, the Business Endless Data plan is now available as an additional connection if you are on an eligible Wireless broadband plan. Business Endless Data is not designed to replace a broadband connection. Tethering and hotspot use is prohibited unless you buy a Hotspot extra, and data speeds will be monitored and may vary. Wireless Broadband provides a more suitable level of service to support the way customers use the internet at home or office environments.
