Spark Open Audition competition terms

By participating in the Spark Open Audition competition advertised by Spark on its TikTok channel(the Competition), you accept and agree to the following terms and conditions along with the terms set out in the “What you need to know” section on spark.co.nz/hellotomorrow, which are incorporated into these terms and conditions: 

  1. Benefit Acceptance: In order to receive the Benefits, the Mentees must: 
    • a) re-confirm acceptance of these terms and conditions; 
    • b) agree to participate in the one-on-one mentorship program during the specified dates; 
    • c) agree to perform live on the radio show arranged by Spark; and
    • d) enter into a contract with Spark for performance and content production relating to the one-on-one mentorship and radio production and agree to particate in Spark’s background checks and talent onboarding process. 
  2. Privacy and background checks: You agree that Spark may carry out desktop background checks in relation to you using publicly available information for the purposes of considering selection criteria. Your personal information will be collected and used in accordance with Spark’s privacy policy. You have the right to access, update and correct such information.
  3. Direct contact: you agree that Spark may contact you directly via TikTok in relation to your Entry in relation to the process of selecting the Mentees.
  4. Public Voting: Public voting will be conducted fairly and in accordance with the rules set out by Spark at the time of the Public Vote. Any attempts to manipulate voting or engage in fraudulent behaviour may result in disqualification.
  5. Eligibility: This competition is not open to employees of Spark, its agents, contractors, consultants, or their families (including de facto spouses) or to other persons assisting with the Competition.
  6. Promoter: The Promoter of the Competition is Spark New Zealand Trading Limited (Spark).
  7. TikTok: The Competition is in no way sponsored, endorsed or administered by, or associated with Tiktok.
  8. No liability for TikTok: By engaging in this Competition, you understand and agree that you are providing your information to Tiktok and that Tiktok is in no way responsible or liable to you for anything arising directly or indirectly out of, or in connection with, your involvement with this Competition.
  9. Judging: All valid Entries received by the specified end date and which have not been disqualified will be considered. One Entry per person is permitted and Spark will disregard all subsequent entries from any individual that attempts to submit more than one Entry.
  10. Late or failed Entries: Spark is not responsible if you have caused, or are responsible for any late, lost, or misdirected entries which may result in delay or failure to enter you into the Competition.
  11. Mentee and/or Winner reselection: Spark will endeavour to notify each of the Mentees and the Winner by email, text or phone. If Spark selects an Eligible Participant to be a Mentee and that participant does not meet the criteria enabling them to receive the Benefits, Spark may reselect a new Mentee without liability to any person. If Spark cannot contact the Winner within three working days of announcing the winner of the Public Vote, Spark may redraw a new winner without liability to any person. Spark reserves the right to contact the selected winners by other means.
  12. Costs and Expenses: The Benefits and the Prize cannot be transferred, exchanged or redeemed for cash. Spark takes no responsibility for Entries or prizes that are lost or destroyed. Spark accepts no responsibility or liability for any Mentee’s enjoyment of the Benefits, or the Winner’s enjoyment of the Prize or any other costs and expenses that may be incurred by the Mentees or the Winner relating to the Benefits and/or the Prize or the Mentee’s/Winner’s enjoyment of those Benefits/ that Prize (including any travel related costs where relevant).
  13. Decisions: The decisions of Spark on all matters relating to this Competition are final and no correspondence will be entered into. Spark reserves the right to verify the validity of an Entry or a Winner’s/Mentee’s right to redeem the Prize/ Benefits in accordance with these terms and conditions. In the event that the Benefits or the Prize is not available due to events outside of Spark’s reasonable control, Spark may amend the Benefits and/or Prize offered.
  14. Modification or Cancellation: Spark NZ reserves the right to modify, suspend, or cancel the competition without notice in the event of any unforeseen circumstances that may affect its fairness or integrity.
  15. Governing Law: This competition is subject to the laws of New Zealand, and any disputes will be resolved in accordance with those laws.
  16. Liability: To the extent permitted by law, Spark excludes any liability it may have to you arising directly or indirectly out of or in connection with this Competition.
  17. Publicity: Entering the competition or accepting the Benefits or the Prize constitutes a Mentee’s/Winner’s consent to be photographed, filmed, recorded and/or interviewed by Spark and other interested media outlets and to use their name, likeness, voice, city/town of residence, competition entry and/or photographs, recording, videos for Competition or publicity purposes without compensation. This includes Sparks website, direct and social media channels and PR.
