Netflix with Spark terms and conditions

These terms apply when you get Netflix through your Spark plan.

Netflix is included in the following Spark plans:

1) Spark's Unplan Netflix and Unlimited Netflix Broadband plans ("Netflix with broadband service"); and 

2) Spark's $79.99 Endless Mobile Plan with Netflix ($69.56 excl.GST) and $99.99 Endless Group Plan with Netflix ($86.95 excl.GST) ("Netflix with Mobile service").

General:

1) What you get: One Netflix Standard HD subscription is included in the Netflix with broadband service and the Netflix with mobile service.

2) The offer is subject to change.

3) Your usage: Data usage incurred from watching Netflix content online will count toward your monthly broadband or mobile data allowance.

4) Queries: Customer queries relating to the Netflix service should be directed to Netflix at help.netflix.com

5) What you need: A Netflix compatible device (manufactured and sold separately) and internet connection are required to watch Netflix.

6) What terms apply: Spark’s Netflix offer is subject to applicable law and the Netflix Terms of Use, and these terms that you’re reading right now. These terms apply alongside our Personal Terms (if you're a consumer), or our Business Terms for business customers. You can read these at spark.co.nz/terms. If and to the extent that the Netflix Terms of Use related to billing, payments and cancellations conflict with the Spark Personal Terms, or Spark Business Terms, the relevant Spark Terms shall prevail.

7) The Netflix service is provided to you by Netflix International B.V., a Netherlands limited liability company.

8) Activating: In order to enjoy the Netflix service as part of your Spark service, you'll need to activate the Netflix service by completing the Netflix activation process. You can do this by logging into your MySpark online account. If you don’t have a MySpark online account you can set one up online. Set up a MySpark account

Business customers can also set up a MySpark account. Set up a Business MySpark account

9) Existing Netflix customers: If you already have an existing Netflix account, you can link it to your Spark service when you activate Netflix as part of your service. Netflix will continue to charge you separately for your existing Netflix account until you link that account to your Spark service. For any queries regarding your billing with Netflix for your existing Netflix account please contact Netflix directly at https://help.netflix.com/en/

10) If you link an existing Netflix account to your Spark service, terminating that Spark service will not automatically cancel your Netflix membership, and Netflix will automatically resume charging your existing payment method that they have on file once your Spark service ends. If you wish to review the details of your Netflix membership please visit the ‘Account’ pages on the Netflix website.

11) Your information: Spark will share the email address registered to your Unplan Netflix or Endless Mobile Netflix service with Netflix in order for Netflix to provide you with the Netflix service. For further information about how Spark handles your personal data, please see the Spark privacy policy. You can view Netflix’s Privacy Statement on netflix.com/privacy

12) The Spark with Netflix service is not redeemable or refundable for cash, and can't be exchanged for a Netflix gift subscription.

13) The Netflix service and any content viewed through the service are for your personal and non-commercial use only. They must not be shared with individuals beyond your household. 

 

Netflix with broadband service

13) Duration of Netflix: You'll continue to receive the Netflix Standard (HD) Streaming plan for the duration of your 12-month Unplan Netflix or Unlimited Netflix broadband plan. This will end when terminated by you (for example, you leave Spark or move to another plan), or Spark, in accordance with the Unplan Terms or the Personal Terms, as applicable. After your 12 month term is up, Netflix will continue to be provided to you via your Netflix with broadband service.

14) This Netflix offer is only included in Unplan Netflix or Unlimited Netflix plans with a minimum 12 month term. An early exit fee of $199 applies if you terminate your broadband plan before the end of your 12 month term.

15) If you signed up to a Netflix eligible broadband plan (including Unplan Entertainment with 6 or 12 months of Netflix and Lightbox included or Unlimited Broadband) on or before 14 April 2019, and Unplan Entertainment with Netflix and Lightbox included or before 6th July 2020 please refer to these retired terms. View Retired Spark on Netflix terms

 

Netflix with mobile

16) Duration of Netflix: You'll continue to receive the Netflix Standard (HD) Streaming plan for the duration that you're on your Netflix with mobile plan, which will end when terminated by you (for example, you leave Spark or move to another plan), or Spark, in accordance with the Mobile and Wireless Terms and Endless Mobile Group Plan Terms as applicable.
