The Business Mobile Postpaid Agreement applies in addition to the following terms and conditions.

Rollover Data

  • Eligible plans: Rollover Data only applies to the data included in the Spark Rollover Postpaid Plans. Data included in mobile plans or packs which pre-date 11 September 2017, Business Endless Plan, Spark Digital Mobile Plans, or any Mobile extras does not roll over.
  • Expiry: At the date of your Rollover Pack or Plan renewal, unused data from that pack or plan will roll over, up to a total of 3.5GB, for you to use for up to 365 days after the date of original purchase.
  • Usage: You may use your Rollover Data while you remain on a Rollover plan. Should you move to an ineligible Plan your Rollover Data will be frozen. While your data is frozen, the 365 day expiry period will continue to run. If you purchase a Rollover Plan within the expiry period, you can continue using your Rollover Data up until expiry and also accrue new Rollover Data.
  • Accrual limits: The maximum total amount of Rollover Data you can accumulate is 3.5GB. Once you’ve reached the 3.5GB data maximum, any new data that rolls over will replace the corresponding quantity of oldest data. Rollover Data is used in order of expiry, and data quantities expiring soonest will always be used first. For example, if in May you rollover 1.5GB and in June you rollover 2GB, you will have reached the total maximum of 3.5GB. If you add another 1GB of rollover in July part of your May rollover will drop off. This means your total will remain 3.5GB comprising of May 0.5GB + June 2GB + July 1GB. If you then run out of data in August, your oldest rollover data (0.5GB from May) will be used first.
  • Order of usage: The data allowances available to you will be used in the following order: 1. Any data included in your Pack or Plan, or extra, in order of expiry 2. Any rollover data accumulated If you share your data with Spark customers on Sharer plans, your accumulated Rollover Data will be shared, and will be used by Sharer plan users in the same order as stated above. If you move off a Rollover Plan, the Share Plan users will lose access to any of your remaining accrued Rollover Data.
  • Checking Rollover accrual and usage:Login to MySpark dashboard or Spark app to check your accumulated rollover and expiry dates. We will inform you of any expiring rollover data within 30 days of expiry.
  • General: Save for as provided by these terms, accumulated Rollover data is non-refundable, not redeemable for cash or other, and is not otherwise transferrable to another person.

Rollover Minutes

  • Eligible plans: Rollover Minutes only apply to the NZ calling minutes included in the Spark Rollover Postpaid Plans which don’t include unlimited calling. Rollover doesn’t apply to NZ/AU Minutes, Spark Digital Mobile Plans, mobile plans or packs which pre-date 11 September 2017, Business Endless Plan, or any Mobile extras.
  • Expiry: At the date of your Rollover Pack or Plan renewal, any unused included minutes will roll over up to a total of 500 minutes, for you to use for up to 365 days after the date of original purchase. 
  • Usage: You may use your Rollover Minutes while you remain on an eligible Rollover plan. Should you move to a non-eligible Plan your Rollover Minutes will be frozen. While your minutes are frozen, the 365 day expiry period will continue to run. If you purchase a Rollover Plan within the expiry period, you can continue using your Rollover Minutes up until expiry and also accrue new Rollover Minutes.
  • Accrual limits: The maximum total amount of Rollover Minutes you can accumulate is 500. Once you’ve reached the 500 minute maximum, any new minutes that roll over will replace the corresponding quantity of oldest minutes. Rollover Minutes are used in order of expiry, and minutes expiring soonest will always be used first. For example, if in May you rollover 200 minutes and in June you rollover 300 minutes, you will have reached the total maximum of 500 minutes. If you add another 100 minutes of rollover in July part of your May rollover will drop off. This means your total will remain 500 minutes comprising of May 100 minutes + June 300 minutes + July 100 minutes. If you then run out of minutes in August, your oldest rollover minutes (100 minutes from May) will be used first.
  • Order of usage: The minutes allowances available to you will be used in the following order: 1. Any minutes included in your Pack or Plan, or extra, in order of expiry 2. Any rollover minutes accumulated
  • Checking Rollover accrual and usage:Login to MySpark dashboard or Spark app to check your accumulated rollover and expiry dates. We will inform you of any expiring rollover minutes within 30 days of expiry.
  • General: Save for as provided by these terms, accumulated Rollover minutes are non-refundable, not redeemable for cash or other, and is not otherwise transferrable to another person.

Extras

  • Customers will be charged straight away on subscribing for the service.
  • At the end of the month any remaining unused minutes, text or data will expire. The customer will be sent warning texts before the renewal date that the unused allocation is about to expire
  • Extras are not pro rated and will not be refunded
  • The extra fee is deducted and added to your account from the time the extra is purchased
  • Extras are effective from the date it is applied / purchased
  • An extra includes a set amount of text, data or minutes which is effective for a set period of time. At the end of the effective period, any remaining allocation will expire
  • A One Off extra is purchased once and expires automatically at the end of the subscription period
  • A recurring extra is purchased once and on the expiry date, the subscription will recur automatically
  • The customer's expiry date will remain the same
  • A Bonus extra is a free allocation of text, data or minutes. (i.e. One off promotional activity)
  • Customers can have multiple extras for the same product type (text/data/minutes)
  • Bonus extras will be used first then the oldest remaining extra
  • Customer will be alerted via SMS prior to any extra expiry or renewal date unless that customer chooses to turn off Alerts and Notifications for that extra
  • If you are on an Ultra Plus Shared plan each Sharer can subscribe to an extra, however extras cannot be shared between mobile connections on the same account.

Ultra Mobile Plans

New Terms apply from 17 August 2017

The Business Mobile Postpaid Agreement applies in addition to the following terms and conditions.

Contract term option

You can choose 24 month Minimum Term on the Ultra Mobile plans.

No fixed Term Contract

No fixed term contract (also known as "open term contract") is available on Ultra Mobile plans.

Call charges

The minimum call charge for your Ultra Mobile plans is one minute except for operator assisted and premium numbers; after the first minute you pay per minute. Every call you make is charged at the rate applicable to your Ultra Mobile Plan. If there is no answer you won't be charged for the call (note, calls answered by a message service or answering machine are chargeable).

Included minutes

  • Each Ultra Mobile plan includes minute allocations that can be used for calls to any New Zealand network
  • Some Ultra Mobile plans may include unlimited or 'all you need minutes'. Unlimited talk is for standard person-to-person calls to standard NZ numbers (you need to be talking to another person). Excludes premium and special numbers. Unlimited minutes cannot be used for multiple simultaneous calling, re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialling, machine to machine communication (including by using your SIM card in any other device), Cellular Trunking Units (CTUs), or any other activity that Spark considers to be non standard personal usage ("Prohibited Usage"). If we consider that you are engaging in Prohibited Usage we may contact you and ask you to stop such usage. If such Prohibited Usage continues despite notification from us, we may remove your Ultra Mobile plan with unlimited minutes immediately with notice.
  • Some Ultra Mobile Plans include minute allocations that can be used for calls to Australian networks. See your specific Ultra Mobile Plan for details.
  • Included anytime minutes can be used any time of the week, at any time of the day
  • Included minutes only apply to your applicable national voice call rate
  • If your included national voice calling minute allocation expires during a call, the remainder of the call will be charged at the overage rate that applies to your chosen plan. For example, if there are two minutes remaining at the start of your call and that call lasts for 30 minutes, the call will be charged at the overage rate for 28 minutes
  • Included minutes are allocated per billing period. Your included minutes will be refreshed on the first day of each billing period and may not be carried over from one billing period to the next. To find out how many minutes you have left in your billing period cycle, call *333 from your mobile or go to http://m.Spark.co.nz/yt on your mobile
  • Your included minutes roll over on the same date each month, i.e. if your billing period starts on the 5th, your new included minutes allocation will also refresh during the 5th
  • Included minutes expire on termination of your contract and any unused minutes will be lost

Excluded minutes

Any international calls, premium number calls, operator assisted calls, directory related services, chargeable special short code numbers and Prohibited Usage.

Operator assisted calls

You'll be charged the full minute rate for each minute or part minute.

Premium numbers

You'll be charged both the premium number rate and the mobile rate for each minute or part minute.

Voicemail/Cellular Secretary/Executive Secretary

Any number of messages may be checked per access.

Video Calling

Only available when you make video calls to other video calling capable Spark mobiles within New Zealand, or video-capable mobiles on a supported international mobile network in a video-capable coverage area.

Included Texts

  • Each Ultra Mobile plan includes an unlimited amount of national person to person text messages per month.
  • Unlimited text is for standard person-to-person texts to standard NZ numbers (you need to be using your fingers to text another person). Excludes premium and special numbers. Unlimited text cannot be used for Prohibited Usage. If we consider that you are engaging in Prohibited Usage we may contact you and ask you to stop such usage. If such Prohibited Usage continues despite notification from us, we may remove your Ultra Mobile plan with unlimited texts immediately with notice.

Included Data

  • Each Ultra Mobile plan includes a set amount of national data per month ("included data")
  • If you want to increase the amount of your included data you can choose to subscribe to an eligible Data extra at an additional set monthly subscription fee as outlined in your chosen Data extra pricing table.
  • The unused data allowance of your included data cannot be carried forward to the following month.
  • Any data used in addition to your included data allowance in a billable month, will be an additional charge as outlined with your plan.
  • Mobile Data terms and conditions apply to your included data. To the extent of any conflict or inconsistency between these terms and the Mobile Data terms and conditions, these terms will prevail.

Free Mobile Team Calling for Business

The free mobile team calling on Ultra Mobile plans is only available to Business customers. For free mobile team calling all mobiles must be on an Ultra Mobile plan and must be on accounts under the same customer number. Calls diverted from one eligible mobile to another under the same customer number will be included in the free mobile team calling.

Free Voicemail for Business

Free voicemail on Ultra Mobile plans is only available to Business customers. Applies to calls to voicemail while in NZ only.

Plan Transfer

Postpaid customers who have a Minimum Term and want to move to an Open Term plan, will have to pay Disconnection Fees before connecting to an Open Term plan. Postpaid customers who are on a Minimum Term wishing to change their postpaid plan to one which is lower than their current postpaid plan can do so at any time, however Transfer Charges may apply. Refer to our Schedule of Disconnection Fees and Termination Charges.

You may transfer plans only once per your billing period by calling Spark on 123.

Your billing period

Your billing period is the period of time you are billed for calls, texts, data and other associated costs accumulated on your account. You billing period is fixed each month. This means your billing period will roll over on the same date each month, with any included minutes, texts, data or usage refreshed on that same date. Your billing period's rollover date will not change, unless you contact Spark and ask for your bill statement date to be changed. You can find out the rollover date of your billing period from *333.

Changes to these terms

Spark may change, add to or delete these terms, including adding whole new terms at any time. Any changes will be made, and notified to you, either in accordance with your Business Mobile Postpaid Agreement or Spark Mobile Prepaid Agreement (whichever applies).

Smart Open Plans

The Business Mobile Postpaid Agreement applies in addition to the following terms and conditions.

Open Term Contract

Open term contract is the only option available on all connections to Smart Open plans.

Call charges

The minimum call charge for your Smart Open plan is one minute except for operator assisted and premium numbers; after the first minute you pay per minute. Every call you make is charged at the rate applicable to your Smart Open Plan. If there is no answer you won't be charged for the call (note, calls answered by a message service or answering machine are chargeable).

Included minutes

  • Each Ultra Mobile plan includes minute allocations that can be used for calls to any New Zealand network
  • Smart Open $139 includes “All you need mins”, Spark’s Fair Use Policy applies.
  • Included anytime minutes can be used any time of the week, at any time of the day
  • Included minutes only apply to your applicable national voice call rate
  • If your included national voice calling minute allocation expires during a call, the remainder of the call will be charged at the overage rate that applies to your chosen plan. For example, if there are two minutes remaining at the start of your call and that call lasts for 30 minutes, the call will be charged at the overage rate for 28 minutes

$5.85 Business Casual Mobile Plan

Eligibility

Available only to Spark Business or Spark Digital customers.

Contract term

Available on Open Term on the Spark Network only.

Monthly fee

A $5.85 (excluding GST) monthly fee applies to all connections on the $5.85 Business Casual Mobile plan.

  • Calling Circles, On-account free calling, Group Discounting and Deferred Monthly payments are not available on this plan
  • All Postpaid Value Pack extras and My Favourites Extras are not available with this plan.

Call charges

The minimum call charge for your $5.85 Business Casual Mobile plan is one minute except for operator assisted and premium numbers; after the first minute you pay per minute. Every call you make (except those made when you are roaming) is charged at the rate applicable to your $5.85 Business Casual Mobile plan . If there is no answer you won't be charged for the call (note, calls answered by a message service or answering machine are chargeable).

Per minute calling rate

The per minute rate of $0.69 (ex GST) an any NZ network anytime rate for the $5.85 Business Casual Mobile plan, for standard calls. Special chargeable numbers have different rates. Calls to the Top 5 destinations (Australia, US, UK, Ireland & Canada) is $0.79 (ex GST) per minute all other international destinations cost $1.24 (ex GST) per minute.

Operator assisted calls

You'll be charged the full minute rate for each minute or part minute.

Premium numbers

You'll be charged both the premium number rate and the mobile rate for each minute or part minute.

Data

Data from your mobile is charged at $0.86 (ex GST) for first 10MB, then 25/MB (ex GST) after that.

Voicemail/Cellular Secretary/Executive Secretary

Voicemail is charged 20c (ex GST) per call. Any number of messages may be checked per access.

Plan Transfer

Postpaid customers who have a Minimum Term and want to move to an Open Term plan, will have to pay Disconnection Fees before connecting to an Open Term plan. Spark may change, add to or delete these terms, including adding whole new terms. Any changes will be made, and notified to you, either in accordance with your Business Mobile Postpaid Agreement.

Combo Plan

Eligibility for the Combo plan

Available only to residential and home business customers. You need to have landline access with Spark on the same account number to be able to place and keep your mobile on the Combo plan.

Contract term

Available Open Term on the Spark Network only.

Call charges

The minimum call charge for your Combo Plan is one minute except for operator assisted and premium numbers; after the first minute you pay per minute. Every call you make is charged at the rate applicable to your Combo Plan. If there is no answer you won't be charged for the call (note, calls answered by a message service or answering machine are chargeable).

Included minutes

  • Combo Plan includes minute allocations that can be used for calls to any New Zealand network at any time
  • Included minutes only apply to your applicable national voice call rate
  • If your included national voice calling minute allocation expires during a call, the remainder of the call will be charged at the overage rate that applies to your Combo Plan. For example, if there are two minutes remaining at the start of your call and that call lasts for 30 minutes, the call will be charged at the overage rate for 28 minutes
  • Included minutes are allocated per billing period. Your included minutes will be refreshed on the last day of each billing period and may not be carried over from one billing period to the next. To find out how many minutes you have left in your billing period cycle, call *333 from your mobile
  • Your included minutes roll over on the same date each month, i.e. if your billing period starts on the 5th, your new included minutes allocation will also refresh during the 5th
  • Included minutes expire on termination and any unused minutes will be forfeited on disconnection

Excluded minutes and services

Any international calls, premium number calls, operator assisted calls, directory related services and chargeable special short code numbers. Also excludes any extras. If you wish to use these services you will need to subscribe.

Operator assisted calls

You'll be charged the full minute rate for each minute or part minute.

Premium numbers

You'll be charged both the premium number rate and the mobile rate for each minute or part minute.

Voicemail/Cellular Secretary/Executive Secretary

Any number of messages may be checked per access.

Video Calling

Only available when you make video calls to other video calling capable Spark mobiles within New Zealand, or video-capable mobiles on a supported international mobile network in a video-capable coverage area.

Plan Transfer

Postpaid customers who have a Minimum Term and want to move to an Open Term plan, will have to pay Disconnection Fees before connecting to an Open Term plan. Postpaid customers who are on a Minimum Term wishing to change their postpaid plan to one which is lower than their current postpaid plan can do so at any time, however Transfer Charges may apply. Refer to our Schedule of Disconnection Fees and Termination Charges

You may transfer plans only once per your billing period by calling Spark on 123.

Your billing period is the period of time you are billed for calls and associated costs accumulated on your account. You billing period is fixed each month. This means your billing period will roll over on the same date each month, with any included minutes or usage refreshed on that same date. Your billing period's rollover date will not change, unless you contact Spark and ask for your bill statement date to be changed. You can find out the rollover date of your billing period from *333 and Your Spark.

Share Plans

Contract term

Available on a 24 month contract term on the Spark Network only. The contract term applies to you, the account holder of the Share Plan. Disconnections Fees or repayment of the mobile subsidy may apply if your contract ends early (see Schedule of Disconnection Fees and Transfer Charges). Additional users ("sharers") can be added or removed from the Share Plan, at the account holder's discretion, without incurring early disconnection fees.

Eligibility

Available only to customers with at least two Spark mobile numbers (one of which is used by a sharer) and who agree to have the charges incurred by these mobile numbers billed to the same account holder. The maximum number of sharers you can add to your account on each Share Plan is set out in the pricing information. All mobiles on the Share plan must be under one account with no other Spark products or services being billed to that same account.

Plan and Other Charges

You are responsible for all charges associated with the Share Plan. Charges include the minimum monthly charges, monthly additional user charges (for each sharer), overage charges, extra charges and any other service charges incurred. If you add a sharer to your Share Plan, you authorise that sharer to access and use the services. The charges for your Share Plan can be found in the pricing information.

The account holder must nominate one mobile number on the Share Plan as the primary mobile of the Share Plan ("the Primary Mobile"). The monthly subscription charge for the Share plan will be applied to the Primary Mobile. Each additional mobile number will incur a monthly share user fee as set out in the pricing information for your Share Plan. If the Primary Mobile of the plan is disconnected for any reason, another mobile number on your account must be nominated as the Primary Mobile and the same terms will apply to that mobile number. If you do not nominate a new Primary Mobile, Spark will select one for you.

Ultra Business Mobile Plans

New Terms apply from 17 August 2017

The Business Mobile Postpaid Agreement applies in addition to the following terms and conditions.

Eligibility

Available only to customers registered as a Business or Home Business customer with Spark. To register as a Business you must be a Company/Legal Trading Entity or Sole Trader.

Contract term option

You can choose 24 month Minimum Term on the Ultra Business Mobile plans.

No fixed Term Contract

No fixed term contract (also known as "open term contract") is available on Ultra Business Mobile plans.

Call charges

The minimum call charge for your Ultra Business Mobile plans is one minute except for operator assisted and premium numbers; after the first minute you pay per minute. Every call you make is charged at the rate applicable to your Ultra Business Mobile Plan. If there is no answer you won't be charged for the call (note, calls answered by a message service or answering machine are chargeable).

Included minutes

  • Each Ultra Business Mobile plan includes minute allocations that can be used for calls to any New Zealand network or calls to Australian landline or mobile numbers.
  • Some Ultra Business Mobile plans may include unlimited or 'all you need minutes'. Unlimited talk is for standard person-to-person calls to standard NZ numbers (you need to be talking to another person). Excludes premium and special numbers. Unlimited minutes cannot be used for multiple simultaneous calling, re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialling, machine to machine communication (including by using your SIM card in any other device), Cellular Trunking Units (CTUs), or any other activity that Spark considers to be non standard personal usage ("Prohibited Usage"). If we consider that you are engaging in Prohibited Usage we may contact you and ask you to stop such usage. If such Prohibited Usage continues despite notification from us, we may remove your Ultra Mobile plan with unlimited minutes immediately with notice.
  • Included anytime minutes can be used any time of the week, at any time of the day
  • Included minutes only apply to your applicable national voice call rate
  • If your included national voice calling minute allocation expires during a call, the remainder of the call will be charged at the overage rate that applies to your chosen plan. For example, if there are two minutes remaining at the start of your call and that call lasts for 30 minutes, the call will be charged at the overage rate for 28 minutes
  • Included minutes are allocated per billing period. Your included minutes will be refreshed on the first day of each billing period and may not be carried over from one billing period to the next. To find out how many minutes you have left in your billing period cycle, call *333 from your mobile or go to http://m.Spark.co.nz/yt on your mobile
  • Your included minutes roll over on the same date each month, i.e. if your billing period starts on the 5th, your new included minutes allocation will also refresh during the 5th
  • Included minutes expire on termination of your contract and any unused minutes will be lost

Excluded minutes

Any international calls that is not to Australia, premium number calls, operator assisted calls, directory related services, chargeable special short code numbers and Prohibited Usage.

Operator assisted calls

You'll be charged the full minute rate for each minute or part minute.

Premium numbers

You'll be charged both the premium number rate and the mobile rate for each minute or part minute.

Voicemail/Cellular Secretary/Executive Secretary

Any number of messages may be checked per access.

Video Calling

Only available when you make video calls to other video calling capable Spark mobiles within New Zealand, or video-capable mobiles on a supported international mobile network in a video-capable coverage area.

Included Texts

  • Each Ultra Mobile plan includes an unlimited amount of national person to person text messages per month.
  • Unlimited text is for standard person-to-person texts to standard NZ and Australian numbers (you need to be using your fingers to text another person). Excludes premium and special numbers. Unlimited text cannot be used for Prohibited Usage. If we consider that you are engaging in Prohibited Usage we may contact you and ask you to stop such usage. If such Prohibited Usage continues despite notification from us, we may remove your Ultra Business Mobile plan with unlimited texts immediately with notice.

Included Data

  • Each Ultra Business Mobile plan includes a set amount of national data per month ("included data")
  • If you want to increase the amount of your included data you can choose to subscribe to an eligible Data extra at an additional set monthly subscription fee as outlined in your chosen Data extra pricing table.
  • The unused data allowance of your included data cannot be carried forward to the following month.
  • Any data used in addition to your included data allowance in a billable month, will be an additional charge as outlined with your plan.
  • Mobile Data terms and conditions apply to your included data. To the extent of any conflict or inconsistency between these terms and the Mobile Data terms and conditions, these terms will prevail.

Data Stretch

Ultra Business Mobile plans come with Data Stretch. Which means when you exhaust your plan allowance you will be charted 25c (excluding GST) per MB until you rech 80MB of data overage. Your spend will be capped at $20 and you can keep using data until you reach 1024MB. You will be then charged $20 + 25c (ex GST) per MB until you reach 1104MB, your spend will be capped at $40 until you reach 2048MB, you will then be charged $40 + 25c/MB after that.

Free Mobile Team Calling for Business

The free mobile team calling on Ultra Business Mobile plans is only available to Spark Business customers. For free mobile team calling all mobiles must be on an Ultra Business Mobile plan and must be on accounts under the same customer number. Calls diverted from one eligible mobile to another under the same customer number will be included in the free mobile team calling.

Free Voicemail for Business

Free voicemail on Ultra Business Mobile plans is only available to Business customers. Applies to calls to voicemail while in NZ only.

Every call you make is charged at the rate applicable to your Ultra+ Plan. If there is no answer you won't be charged for the call (note, calls answered by a message service or answering machine are chargeable).

Frequently called numbers

Eligibility

The Business Share Plans give you the right to purchase up to 10 "Frequently Called Numbers".

Charges

Each Frequently Called Number costs $8.95 plus GST per month. The term "Frequently Called Number" means a Spark Mobile or a Spark national home line or standard Spark business line number.

Calling to Frequently Called Numbers

Free calling to Frequently Called Numbers applies to all national calls made from a mobile under the same customer number on a Business Share Plan (leader and sharers) to a nominated Frequently Called Number. Calls to Frequently Called Numbers will not reduce your included minutes balance. Fair Use Policy applies. Calls to Frequently Called Numbers must not exceed 2 hours per call and are subject to Fair Use Policy.

Fair Use Policy

Spark operates a Fair Use Policy for all calls between you and the other mobiles on your account. Spark reserves the right to monitor call duration and the number of calls made between the mobiles on your account. If in Spark's reasonable opinion your usage is excessive or unreasonable Spark reserves the right to request that you and the other users/ sharers on your account, reduce your usage and, in the event of continued excessive and/or unreasonable use Spark reserves the right to migrate you and/or some of the other mobiles on your account to an alternative plan for the remaining term of your contract.

TXT extras

  • Only available by subscription on Spark mobile phones connected to the Spark Network and apply to national person to person text messages

Things you should know

Eligibility

Spark mobile customers on an eligible plan are eligible to subscribe to a TXT extra. You can subscribe to more than one TXT extra at a time.

Included texts

TXT extras include a set amount of national person to person text messages within your subscription period as outlined in your chosen TXT extra pricing table. Included texts may not be carried over from one subscription period to another. To find out how many TXT's you have left in month go to www.Spark.co.nz/mbbmeter or Your Spark on device usage meters.

What does 'national' mean?

National texts are texts you send to other mobile phones in New Zealand. This excludes texts sent to international destinations and texts sent while roaming. These will be charged at the applicable international/roaming text rate and are not included within your TXT extra cap.

What does 'person to person' mean?

Person to person text messages are text messages sent by a person using their mobile phone to another person's mobile phone. This does not include text messages sent via automated, computer scripted or other electronic means using a WCDMA modem or tethered (i.e. cable connected) WCDMA handset.

Here are some examples of text messages that are not person to person text messages: text messages sent to short codes, Web TXT or eTXT™, Xtra Alerts, Instant Messaging, Mobile originated text messages to e-mail and text messages you receive that have a charge associated with them. Entering competitions or voting for polls and other additional chargeable text messages are also not included.

What does text message mean?

Text message means a short text message of a maximum length of 160 characters that you have typed into your mobile phone or that you have been sent. Even if your device is capable of sending longer messages (e.g. 320 characters), for charging purposes, every 160 characters you send is counted as one text message. This does not include Picture Messages, WAP, Photo Messages or Video Messages.

When does the TXT extra month start?

  • Your chosen TXT extra provides you with a set amount of included national person to person text messages per month. For example, if you've subscribed to 150TXT extra you will be entitled to send 150 national person to person text messages per month for a set monthly fee
  • Your TXT extra months starts at the time of your subscription to a TXT extra. At the time of your subscription, you may choose to renew your TEXT extra every 30 days (within your subscription period). Your TEXT extra will renew at 12 am on the last day of your subscription period
  • All eligible TXT extra messages you send will be calculated as part of your set maximum per month. Each additional national person to person text message above your TXT extra cap will cost you $0.20 per message. You will not be charged for receiving national person to person text messages

How will I be charged for TXT extra?

Postpaid customers

For Spark mobile customers on a business postpaid plan, TXT extra is billed for on a monthly basis and is based on the customer's monthly bill cycle (your billing period) which can be found on your Spark bill statement.

Postpaid TXT extra 

  • All text messages are charged to your account once sent. It is your responsibility to ensure numbers are valid and correct
  • If you are on a monthly call plan, TXT extra is based on your monthly bill cycle which can be found on your Spark bill statement. You will be charged the subscription value of your TXT extra at the beginning of your monthly bill cycle

My Favourites extras

  • Only available by subscription on Spark mobile phones

Things you should know

Eligibility

To be eligible to receive this service you must be a Spark mobile customer on one of the following plans:

Postpaid

  • Talk & Text Anytime Plans
  • Talk & Text Off Peak Plans
  • Smartphone Plans
  • Smart Open plans
  • Smart One Bill
  • Share plans
  • Ultra Mobile Plans
  • Ultra Open Plans

Nominated Number(s)

You can nominate up to a maximum of three Spark mobile or Spark landline numbers per mobile account at any one time ("Nominated Number(s)"). Excludes calling cards, Call Diversion, Customer Link, Tandem calling, 059, and premium numbers. Excludes international roaming calls, and normal call charges will apply when roaming overseas.

Charges for Nominated Number(s)

Each each Nominated Number will incur a monthly subscription charge of $6 charged to your Spark mobile account and payable by you. 

Calls to your Nominated Number(s)

This service applies to one-way direct dial voice calls from your Spark mobile to the Nominated Number(s). There is a 2 hour limit per each call. The monthly subscription charge excludes return calling from the Nominated Number(s). Text messaging, picture/photo messaging, video messaging, video calling and MMS are also excluded. This offer entitles you to make many calls, anytime of the day, during your billing cycle, whichever is applicable, to your Nominated Number(s) for the fixed monthly subscription charge. Fair Use Policy applies.

The Fair Use Policy

The Fair Use Policy is referenced against average customer profiles and estimated customer use of this service. If your use materially exceeds estimated use patterns over any month, then your use will be deemed excessive and/or unreasonable. If you breach this policy Spark may ask you to moderate your usage. If you fail to do so, Spark reserves the right, without further notice, to remove the service from your account.

How can I subscribe, cancel or make changes to My Favourites extra?

You are able to 'self-provision' the purchase or cancellation of the service via Online or TXT. You are able to contact 123 or our Retail stores for assisted purchase, changes to your service, enquiries or cancellation of the service.

The service may take up to 5 days to be provisioned and you will be notified via text when the service is added, changed or cancelled.

How will I be billed for My Favourites extra?

The service is based on your monthly billing cycle and will be charged to your Spark mobile account from the date of activation, monthly in advance. The service may not be cancelled and no changes may be made within the first 30 days.

Calls to the Nominated Number will not use minutes included in your Monthly Account plans.

The monthly subscription charge for the offer is in addition to all other offers, access and other charges for your Postpaid Account. For example, the $6 is NOT an inclusive product of the One Rate 100 plan construct.

What if I make changes to my plan or the Nominated Number changes?

If you cease to be a Spark mobile customer, switch to an ineligible mobile or deactivate or suspend your account, we will cancel the service.

If the owner of the number you nominated changes that number, this service will remain on your mobile until Spark NZ is advised otherwise by you.

Anything else I should know?

My Favourites extra is not compatible with a permanent Toll bar (both customer requested and credit bars). Customers can have Call Restriction and the service, however, they will need to turn off Call Restriction to make a call to the Nominated Number.

Mobile Data - includes Data plans and extras

  • Spark Network Mobile Data

Spark Network Mobile Data

Availability

Data plans are only available on Spark mobile phones and data devices connected to the Network. This includes the Casual plan, data extras, Mobile Broadband and BlackBerry® plans.

Eligibility

Spark Network data plans are available to residential, home business and business customers. All data plans are available on Postpaid. Data pricing will default to the Casual plan and casual data prices if no other data extra, Mobile Broadband, or BlackBerry plan is selected. BlackBerry devices must have a BlackBerry plan applied.

Data charges

Data pricing applies to both WAP and IP packet data traffic. WAP data is billed per URL retrieved. IP packet data is billed based on bytes consumed, with billing updates triggered by elapsed time, bytes consumed or session end.

If your data plan includes a data allowance, e.g. a monthly or daily data allowance, you will still be able to use data on your device once you reach that allowance limit. You will be charged for all data used over this data allowance.

All BlackBerry devices are subject to BlackBerry plan pricing and monthly data allowances.

Contract term

Mobile Broadband plans are available as open term or 24 month plans. Disconnection Fees or repayment of the mobile subsidy may apply if your contract ends early. Refer to our Schedule of Disconnection Fees and Termination Charges . Note all Data extras are open term.

Fair use policy

Spark operates a Fair Use Policy to ensure excessive, inappropriate or unreasonable use by some customers does not affect the quality of the experience or the integrity of the Spark Network for other customers.

Mobile Broadband is not intended or designed for prolonged intensive data downloads or uploads (including file sharing and long duration streaming videos). Spark's fixed broadband services are much more suited to intensive data transfer applications. If in Spark's reasonable opinion your usage is excessive, inappropriate or unreasonable, Spark reserves the right to request that you stop using the services in this manner and to contact you to discuss a more appropriate product / service for you. In the event of continued excessive, inappropriate or unreasonable use, Spark reserves the right to terminate your Mobile Broadband contract.

Excluded usage and services

Unless specifically stated for international roaming, all data pricing and allowances apply only to data used in New Zealand. Separate international roaming pricing applies for data usage outside of New Zealand.

Voice over Internet Protocol (VoIP) is not supported, and we cannot guarantee that access or performance levels will be maintained.

Any applications you accept for use on your device are your own responsibility. Spark cannot accept responsibility for the effect of applications downloaded to your device, or misuse of your personal information through use of those third party applications.

Plan changes

Postpaid customers who have a Minimum Term and want to move to an Open Term plan, will have to pay Disconnection Fees before connecting to an Open Term plan. Postpaid customers who are on a Minimum Term wishing to change their postpaid plan to one which is lower than their current postpaid plan can do so at any time, however Transfer Charges may apply. Refer to our Schedule of Disconnection Fees and Termination Charges

You may transfer plans only once per your billing period by calling Spark on 123.

Changes to these terms

Spark may change, add to or delete these terms, including adding whole new terms at any time.

Any changes will be made, and notified to you, either in accordance with your Business Mobile Postpaid Agreement.

Postpaid Data

All of the Spark Network mobile data plans are available on Postpaid except for the Prepaid Mobile Broadband 500 MB plan. This includes the Casual plan, data extras, the remaining Mobile Broadband plans and BlackBerry plans. The Casual plan, data extras and BlackBerry plans have been designed for data usage on a mobile phone, and the Mobile Broadband plans have been designed for data usage on a laptop.

Data charges

Data is billed in 10 kB increments on all postpaid plans except the Casual plan and BlackBerry plans. A minimum charge for 10 kB applies and any usage above this minimum is rounded up to the nearest 10 kB.

Your billing period

The start date for any monthly charges and included data allowance is based on your monthly billing period, which can be found on your Spark bill. For all postpaid plans with an included monthly allowance (i.e. all plans except the Casual plan) you will be charged for the data plan one month in advance as a monthly subscription.

Plan transfer

Postpaid customers who have a Minimum Term and want to move to an Open Term plan, will have to pay Disconnection Fees before connecting to an Open Term plan. Postpaid customers who are on a Minimum Term wishing to change their postpaid plan to one which is lower than their current postpaid plan can do so at any time, however Transfer Charges may apply. Usage alerts

Postpaid customers will automatically be subscribed for usage alerts for all plans except the Casual plan. Unfortunately the usage alerts service is not available on the Casual plan. You can access the Mobile Broadband usage meter on your mobile phone or online to keep track of how much data you are using.

Mobile Data Plans

Casual Plan

Unless you select a data extra, Mobile Broadband plan or BlackBerry plan, our Casual plan automatically applies to any data usage.

Availability

Available on Spark mobile phones or data devices connected to the Spark Mobile Network only, for data usage within New Zealand.

Data charges

Data is billed in 10,486 byte increments. A minimum charge for 10,486 bytes applies, and any usage above this minimum is rounded down to the nearest 10,486 bytes.

From 24 June, data will be billed in 10 kB increments. A minimum charge for any usage up to 10 kB applies. Any usage above this minimum is rounded up to the nearest 10 kB.

Included data

The Casual plan includes 10 MB of national data usage on the days you use data, for a capped fee as outlined in the pricing table.Unused data from your daily allowance is not carried forward to the following day.

What does 'national' mean?

National data usage means data used on your mobile phone or data device while in New Zealand. This excludes data used while roaming, which will be charged at the applicable international/roaming data rate and is not included within your daily data allowance.

Your billing period

Customers will only be charged for casual data on the days that they use it.
A day's data entitlement is defined as a calendar day that begins at 12:00am and ends at 11:59:59pm. A WAP data event going past midnight will be charged to the day it started.

How will I be charged for data on the Casual plan?

  • The Casual plan provides you with 10 MB of national included data usage per day, for a capped daily fee. You will only pay for data on the days you use it
  • All eligible data usage will be calculated as part of your 10 MB per day
  • National data is charged at a pro-rated rate up to a maximum of $1 for the first 0.05MB, and from then no data charges apply up to a total of 10 MB in that same day
  • Any further national data usage over 10 MB in that day is charged at $1 per MB. From 24 June, Any further national data usage over 10MB in that day will be charged at 20 cents per MB.
  • If you do not use all 10 MB in a day, the unused data allowance is not carried forward to the following day

Data extras

Available by subscription on Spark mobile phones or data devices connected to the Spark Network only, for data usage within New Zealand. You can only make one change to your data extra per per billing month.

Included data

Data extras include a set amount of national data usage for a set monthly subscription fee as outlined in the data extra pricing table. Unused data from your monthly allowance is not carried forward to the following month.

Your included monthly data allowance is refreshed at 4pm on the last day of your monthly billing period. All data used from 4pm onwards on the last day of your billing period will count towards your next months included data allowance.

How will I be charged for a data extra?

  • Your chosen data extra provides you with a set amount of national included data usage per month. For example, if you've subscribed to the 50 MB data extra you will be entitled to use up to 50 MB of national data per month for a set monthly fee
  • Any data usage over your included monthly allowance will be charged at $0.51 per MB for the rest of your data extra month
  • All eligible data usage will be calculated as part of your set maximum per month
  • You will be charged a subscription fee for your data extra. For example, if you've subscribed to the 50 MB data extra you will be charged $6 to your Spark account each month

Mobile Broadband Plans

Availability

Available by subscription on Spark mobile phones or data devices connected to the Spark Network only, for data usage within New Zealand. You can only make one change to your Mobile Broadband plan per billing month.

Included data

Mobile Broadband plans include a national data allowance for a set monthly fee as outlined in the Mobile Broadband plan page. Unused data from your allowance is not carried forward to the following month.

How will I be charged for a Mobile Broadband plan?

  • Your chosen Mobile Broadband plan provides you with a set amount of national included data usage per month. For example, if you've subscribed to the 2 GB Mobile Broadband plan you will be entitled to use up to 2 GB of national data per month for a set monthly fee
  • All eligible data usage will be calculated as part of your set included data allowance per month
  • For Spark mobile customers on postpaid, you will be charged a subscription fee for your Mobile Broadband plan
  • Customers with a residential or business broadband plan or a Total Home plan with Spark, who apply a postpaid Mobile Broadband plan with a minimum fixed term of 24 months to that account may be entitled to a reduced monthly charge for their Mobile Broadband plan. You may have a maximum of three Mobile Broadband plans on your Spark customer number when you have, and continue to have, a Spark residential or business broadband plan or a Total Home plan, to take advantage of the reduced monthly plan price. If you do not have your home broadband or a business broadband plan with Spark, or you already have the maximum of three Mobile Broadband plans on your Spark account with a residential or business broadband plan or a Total Home plan, you will not be entitled to this reduction in Mobile Broadband monthly plan price
  • If you happen to go over your included data allowance on your Mobile Broadband plan then you will be charged for 'Overage'. The charges for this overage depend on the Mobile Broadband plan you have chosen. All Mobile Broadband plans include the ability to use double the set amount of national included data in a month for a fixed price. Once you exceed this further allocated data allowance in your allocated month then each MB will be charged for at the advertised price. Please refer to the pricing table for the Mobile Broadband charges that apply when you have used up your allocated data allowance

BlackBerry Data Plans

Availability

Available by subscription on BlackBerry devices connected to the Spark Network only, for data usage within New Zealand. You can only make one change to your BlackBerry plan per billing month.

BlackBerry plan pricing applies to BlackBerry, WAP and IP packet data traffic. BlackBerry data plans will only be assigned to BlackBerry devices. Non BlackBerry mobile devices will not have BlackBerry plans assigned to them.

Your calling and text plans are not BlackBerry specific.

Spark New Zealand is not responsible for any outages that may occur from time to time at RIM and consequently will not provide reimbursements or financial compensation to customers as a result.

Included data

Your included monthly data allowance for your BlackBerry plan is refreshed at 4pm on the last day of your monthly billing cycle. All data used from 4pm onwards on the last day of your billing cycle will count towards your next months included data allowance.

How will I be charged for a BlackBerry plan?

  • All BlackBerry data is billed in 5 kB packets consumed, with billing updates triggered by elapsed time, bytes consumed or session end
  • Your chosen BlackBerry plan provides you with a set amount of national included data usage per month. For example, if you've subscribed to the BlackBerry 1 GB plan you will be entitled to use up to 1 GB of national data per month for a set monthly fee. Unused data is not carried forward to the following month
  • Any data usage over your included monthly allowance will be charged at 51 cents per MB for the rest of your data month for all three plans as listed above
  • All eligible data usage will be calculated as part of your set included data allowance per month
  • You will be charged a subscription fee for your BlackBerry plan each month in advance

BlackBerry Park Plan

BlackBerry devices which are temporarily disconnected by users will not be de-provisioned on the RIM servers. BlackBerry devices will have a specific BlackBerry Park Plan. The BlackBerry Park Plan will only be assigned to BlackBerry devices.

XT Onebill Plan

The Business Mobile Postpaid Agreement applies in addition to the following terms and conditions.

Eligibility for the XT Onebill plan

Available only to residential and home business customers. You need to have fixed line access and calling with Spark on the same account number to be able to place and keep your mobile on the XT Onebill plan.

Contract term

Available on a 24 month contract or Open Term on the Spark Network only.

Call charges

The minimum call charge for your XT Onebill Plan is one minute except for operator assisted and premium numbers; after the first minute you pay per minute. Every call you make (except those made when you are roaming) is charged at the rate applicable to your XT Onebill Plan. If there is no answer you won't be charged for the call (note, calls answered by a message service or answering machine are chargeable).

Included Texts and per minute rate

  • XT Onebill plan includes 200 texts that can be used for texts to any New Zealand network at any time when you are in New Zealand (ie excl texts sent while roaming).
  • The per minute rate of $0.69 is an any NZ net anytime rate for the XT Onebill plan.
  • Included texts are allocated per billing period. Your included texts will be refreshed on the last day of each billing period and may not be carried over from one billing period to the next. To find out how many texts you have left in your billing period cycle, call *333 from your mobile
  • Your included texts roll over on the same date each month, i.e. if your billing period starts on the 5th, your new included text allocation will also refresh during the 5th
  • Included texts expire on termination and any unused texts will be forfeited on disconnection

Excluded minutes and services

Any international calls, premium number calls, operator assisted calls, directory related services and chargeable special short code numbers and calls made or texts sent while roaming. Also excludes TXT, My Favourites and data extras. If you wish to use these services you will need to subscribe.

Operator assisted calls

You'll be charged the full minute rate for each minute or part minute.

Premium numbers

You'll be charged both the premium number rate and the mobile rate for each minute or part minute.

Voicemail/ Cellular Secretary/ Executive Secretary

Any number of messages may be checked per access.

Video Calling

Only available when you make video calls to other video calling capable Spark mobiles within New Zealand, or video-capable mobiles on a supported international mobile network in a video-capable coverage area.

Your billing period

Your billing period is the period of time you are billed for calls and associated costs accumulated on your account. You billing period is fixed each month. This means your billing period will roll over on the same date each month, with any included texts or usage refreshed on that same date. Your billing period's rollover date will not change, unless you contact Spark and ask for your bill statement date to be changed. You can find out the rollover date of your billing period from *333 and Your Spark.
