Trade Up terms and conditions

Trade up for $149 incl. GST ($129.57 excl. GST) any time after 12 months, when you sign up each year to our $52.17, $59.99 or above Open Plans on 24 months interest free.

Offer allows you to upgrade to the latest eligible handset provided you meet the eligibility criteria set out in these terms and conditions.

  1. These terms and conditions apply in addition to our Mobile Postpaid Terms and Conditions and any other specific terms and conditions applying to your Plan or Account with Spark, including the Interest Free Payment Terms and Conditions. This offer is subject to availability and release of each new mobile by its manufacturer.
  2. You are automatically eligible for this offer when:
    • you purchase a new selected handset (Eligible Handset) on a 24 month interest free payment option; and
    • sign up to any eligible $52.17, $59.99 and above Open term plan (Eligible Plan) or an open term shared leader plan. Customers must stay on the Eligible Plan for 12 months consecutively to be eligible to trade up.
  3. With this offer you will have the right to upgrade to the latest eligible handset (New Handset) after 12 months or when the new mobile by its manufacturer releases their new phone, whichever occurs later, provided that:
    1. you have paid in full 12 consecutive monthly charges in respect of your Eligible Plan and monthly instalments and there are no current amounts outstanding to be paid on your Spark Account; and
    2. you return your current Eligible Handset in undamaged and in good working condition which meet Sparks ‘working condition’ criteria set out in clause 5 below and does not contain any faults which constitute a non-working phone (see clause 5).
    3. the New Handset is eligible for an upgrade exchange with your existing Eligible Handset; and
    4. on redemption of your New Handset you:
      1. pay a further $149 incl. GST ($129.57 excl. GST) trade up Redemption Fee.
      2. Continue to subscribe to an eligible Postpaid Plan and sign up to a new interest free payment option for 24 months
  4. Eligible Plans include; Mobile $59.99 Plan, Mobile $59.99 Share Plan, Mobile $79.99  Plan, Mobile $79.99 Share Plan, Mobile $99.99 Plan, Mobile $99.99 Share Plan, Business Pay Monthly $52.17 Mobile Plan, Business Pay Monthly $70.85 Mobile Plan, Business Pay Monthly $70.85 Mobile Share Plan, Business Pay Monthly $100.85 Mobile Plan
  5. For the purpose of clause 3(b) a handset is undamaged and in good working condition if it meets the following “working phone” definition at the time of redemption:
    • switch on and off
    • Be complete with battery and back cover (chargers are not required)
    • The integral bodywork should have no cracks, missing plastics / metal and there should be no missing buttons
    • The bodywork should not be hanging off the main body of the phone in any way
    • The LCD must be working and power up correctly, load the mobile's home screen and be able to access applications
    • The LCD must have no lines or missing pixels
    • The screen must be intact with no cracks
    • There should be no liquid damage
    • A white screen does not constitute a working phone
    • The stylus must be included if originally sold with the mobile
    • Slider mechanisms must function correctly
    • the handset‘s IMEI is not blocked or blacklisted by any New Zealand mobile network.
    The following faults will constitute a 'non-working' phone:
    • Missing battery or back cover
    • Missing buttons or cracked/missing bodywork
    • Doesn't power up beyond a white screen or welcome note
    • LCD has missing lines or pixels
    • Cracked screen
    • Liquid damage
    • Non-responsive touch screen
    • Badly scratched
    • Missing stylus
    • Faulty slider or hinge mechanism
    The following faults are completely unacceptable:
    • Crushed, bent or broken in half
    • Missing a key component; Screen, Camera or Keypad
    • Very badly soiled
    Extra points to note for iPhones:
    • A missing SIM gate constitutes a 'non-working' iPhone.
    • iPhones need to have the Find My Phone app disabled.
  6. You acknowledge and agree that once you return your current Eligible Handset all of your information and data stored on that Eligible Handset will be lost. The ownership, title and rights in the Eligible Phone will automatically transfer to Spark.
  7. Subject to clause 10 and 11, once you have upgraded to a New Handset on an Eligible Plan and 24 month interest free payment option in accordance with clause 3, your previous Eligible Plan will be cancelled and you will not be required to pay any further charges in respect of your original Eligible Handset.
  8. Where you have upgraded to a New Handset but your original Eligible Handset;
    1. does not comply with the conditions set out in clause 5; or
    2. is never returned; or
    3. where you wish to opt out of this offer, you will be required to pay Spark the full balance outstanding for any Eligible Handset (minus the Redemption Fee) and any charges that may apply in respect of the cancellation of your previous Eligible Plan.
  9. You will not receive a refund of any of the payments you have made in respect of your Eligible Handset.
  10. Not all plans and handsets offered by Spark will be eligible for this offer. Spark reserves the right to change the plans and handsets eligible for this offer at any time at its discretion.
  11. Redemption of a New Handset is available only from Spark Retail Stores (SRS), dealer stores, or Business Hubs
  12. Customers must be 18 years of age or over to complete a trade up transaction.
