Mobile Trade-In Terms and Conditions

These trade in terms and conditions apply in addition to your Spark Mobile Postpaid Agreement and any other Spark Mobile service specific terms and conditions relating to the mobile services you receive from Spark as published at www.spark.co.nz ("Applicable Terms and Conditions"). We recommend you read these trade in terms and conditions carefully before completing the trade in of your mobile device and retain a copy of these terms and conditions for future reference.

    Interpretation

  1. Unless stated otherwise, words and phrases in these trade-in terms and conditions have the same meaning given to them in the Applicable Terms and Conditions. In addition:
    "Device List" means the list of Eligible Trade in Devices, as published in a Spark store and updated regularly by Spark.
    "Fake device" means a counterfeit device which is manufactured to resemble a device made by another company in breach of the Copyright Act (or other applicable law).
    "Eligible Trade in Device" means a device on our Device List, being Fully Functional at the time of the trade in, which you release to Spark as part of the Trade in Transaction.
    "Fully Functional" means the Eligible Trade in Device has all standard functionality and software in full working order, is able to be turned on, carries no cracks on the screen or missing buttons or pixels and is complete with battery and back cover.
    "Lost, Blocked or Stolen Device" means a device that has been reported as either lost or blocked or stolen, as recorded in any of the stolen asset registers or "Blacklist" register maintained by the NZ Police and/ or New Zealand mobile operators.
    "Trade-in Value" means the value of your Eligible Trade in Device as stated on the Device List on the day you complete the Trade in Transaction.
    "Trade in Transaction" means a transaction whereby you trade in at least one Eligible Trade in Device and a maximum of three Eligible Trade in Devices as part-payment for a new device on a new or resigned Spark Mobile Postpaid Agreement.
  2. General terms

  3. You must be over 18 years of age or over to complete a Trade in Transaction.
  4. If you trade in an Eligible Trade in Device, you will receive an amount equal to the trade in Value of that Eligible Trade in Device which you may put towards the purchase of a new device on a Spark Pay Monthly plan.
  5. If the Trade in Value of your Eligible Trade in Device/s is greater than the amount of your new device, the difference in the amount will be credited to your Spark account.
  6. You can trade in a maximum of three Eligible Trade in Devices, up to a maximum Trade in Value of $1349.00 per Trade in Transaction. Spark will determine in its sole discretion the value of your Eligible Trade in Device(s).
  7. Trade in Value cannot be used to pay any amount owing on your bill, add airtime credit to your account or be redeemed for cash.
  8. Trade ins are only available at participating Spark branded stores.
  9. Eligibility for trade ins are at all times at the sole discretion of Spark.
  10. Removal of SIM, data and personal information

  11. It is your responsibility to remove your SIM card, and delete data and any personal information from the Eligible Trade in Device before completing the Trade in Transaction.
  12. If you fail to remove your SIM card and/or delete all data and personal information from the Eligible Trade in Device, you agree to release us from all claims, losses or damages with respect to the use of SIM card, data or any personal information whether arising before or after you release your Eligible Trade in Device to us.
  13. Once you release any SIM card/s and/or data and/or personal information to us you agree that these are non-returnable.
  14. We accept no responsibility in relation to the security, protection, confidentiality or use of any personal information which is stored on your Eligible Trade in Device and/or memory card and/or SIM card.
  15. Functionality of Phone

  16. Each Eligible Trade in Device must be Fully Functional when offered as a trade.
  17. Lost, Blocked Stolen or Fake Phones

  18. We will not accept devices for trade in which we determine to be a Lost, Blocked or, Stolen Device or a Fake Device.
  19. We reserve the right to reclaim any Trade in Value that you received as part of a Trade in Transaction if it is discovered within three months of the trade in Transaction that the device is a Lost, Blocked or Stolen Device or a Fake Device.
  20. Fraud

  21. Spark NZ reserves the right to inform the relevant authorities if there is any suspicion that there is a deliberate attempt to commit fraud.
  22. Disclosure of personal information

  23. We will collect information about you as part of the Trade in Transaction. You acknowledge and agree that, from time to time, we may disclose some or all of this personal information to third parties to validate your identity and to assist with the prevention and investigation of fraud.
  24. Phone Ownership

  25. By trading in your Eligible Trade in Device you declare and acknowledge that you are the sole owner of such device, you have the right to sell or dispose of such device to any third party and it is free and clear of all security interests, liens and other encumbrances (including, but not limited to, any security interest as defined in the Personal Properties Securities Act 1999)
  26. By trading in your eligible Trade in Device you also declare and acknowledge that you are willingly transferring title and ownership of such device to us and you acknowledge that such device cannot be returned to you after the Trade in Transaction.
