Music Terms

These Terms and Conditions apply to your use of and participation in the Music programme.

By participating in Spark Music pre-sales competitions, S @ Spark Arena and other music promotions and experiences you'll receive Spark Music updates by email or SMS. You'll be among the first to hear about exclusive access to concert pre-sales, competitions, the latest products and promotions, entertainment options and epic music experiences. You can opt out of these by clicking unsubscribe on emails we send you.

As part of the Music programme, Spark may from time-to-time provide access to pre-sale music concert ticket offers ("Pre-Sale Tickets"), reserved seating offers ("Reserved Seating") and/or discounted music concert ticket offers ("Discounted Tickets") (together "Special Tickets") offered and supplied by a third party ticket vendor ("Ticket Vendor") and other music experiences, to active customers of Spark who hold a valid account number or service number for any Spark service ("Customer", "you").

In order to gain access to Special Tickets, you will need to access the Music page on the Spark website or the Events page in the Spark app and validate through Self Service or using your Account Number for a particular Special Ticket offer while the registration window is open. Once you have gone through the validation process, Spark will provide you with instructions about purchasing online on the website of the Ticket Vendor for that offer.

When an offer to purchase Pre-Sale Tickets is live, you will have the opportunity to secure tickets before the general public through the relevant Ticket Vendor’s website. This will occur during a pre-sale window which is exclusive for our Customers. Ticket prices are set out on the relevant Ticket Vendor's website and are subject to that Ticket Vendor’s terms and conditions. Tickets are strictly subject to availability during the pre-sale window and the maximum number of tickets available to purchase per customer may vary. A selection of seating is available throughout the venue for Pre-Sale Tickets, however it does not provide preferential seating over the general public.

When an offer to purchase Discounted Tickets is live, you will have the opportunity to secure tickets through the relevant Ticket Vendor’s website. This is an exclusive offer for our Customers. Ticket prices are set out on the relevant Ticket Vendor’s website and are subject to that Ticket Vendor's terms and conditions. Tickets are strictly subject to availability and the maximum number of tickets available to purchase per customer may vary. A selection of seating is available throughout the venue for Discounted Tickets, however it does not provide preferential seating over the general public.

When an offer to purchase Reserved Tickets is live, you will have the opportunity to secure tickets through the relevant Ticket Vendor’s website. This offer is for all Spark customers. Ticket prices are set out on the relevant Ticket Vendor’s website and are subject to that Ticket Vendor's terms and conditions. Tickets are strictly subject to availability and the maximum number of tickets available to purchase per customer may vary. A selection of seating is available throughout the venue for Reserved Tickets.

The relevant Ticket Vendor is solely responsible for the Special Ticket redemption and fulfilment, and purchase Special Tickets is subject the relevant Ticket Vendor’s terms and conditions (see the Music page on spark.co.nz/music to find out more). Spark only offers access to Special Tickets and does not otherwise supply the Special Tickets themselves. Accordingly and except for those that cannot be excluded by law, Spark excludes all representations and warranties in respect of the Special Tickets. To the extent permitted by law, Spark will not be responsible or liable for:

  • the accuracy, content and use of the Ticket Vendor’s website, or use of the Special Tickets (including ticket redemption and fulfilment); any Special Ticket that may be lost, stolen, forged, damaged or tampered with in any way before it reaches the Customer;
  • any loss or damage whatsoever (including but not limited to direct or indirect loss) or personal injury suffered or sustained in connection with the event related to the Special Tickets; or
  • changes, cancellations or postponements to events the subject of a Special Ticket offer.

Spark is not responsible for any technical difficulties with the Ticket Vendor’s website, and does not warrant that the Ticket Vendors' websites will be available at all times. If you have a query or complaint about a Special Ticket or the event, please contact the relevant Ticket Vendor.

When a Customer terminates all Spark services, they will no longer be able to access Special Tickets, or any other aspect of the Spark Music programme. Clients purchasing Mobile Services through Spark's All-of-Government Mobile Voice and Data agreement with the Ministry of Business Innovation and Employment are not eligible for the Music Programme. Gifting tickets to staff may have Fringe Benefit Tax implications and we recommend you check with your accountant and/or tax advisor.

Spark reserves the right in its discretion to change, cancel or suspend this offer without notice, and this will be effective upon the updated terms and conditions being posted on the Music website.

Spark's use of your name, email, phone number and other personal information is conducted in accordance with the Spark Privacy Policy.

S @ Spark Arena

S is a hospitality lounge and experience space. It's intended for Spark customers as a place to relax before the show they have tickets to attend:

  • S @ Spark Arena is first in, first served and subject to availability due to capacity
  • In order to access S @ Spark, customers must have valid tickets to the concert they are attending.
  • The layout of the Arena per show determines access to S @ Spark. Some shows may only allow those with seated tickets to have access.
  • Spark reserves the right to refuse entry to anyone, including intoxicated people, at our discretion
  • S @ Spark Arena is exclusive to Spark customers and their guests only

Competitions and giveaways

Spark respects the privacy of visitors of http://www.spark.co.nz/music ("Spark Music website") by disclosing and explaining in this Privacy Policy ("Policy") how Spark collects, uses and shares information about you from the Music website and the choices that you can make about the way your information is collected, used and shared. This Privacy Policy applies to all services available on the Music website and Events section in the Spark app. By visiting this website or app, you are agreeing in advance to the current and future terms of this Privacy Policy. If you do not wish to agree to these terms, you should leave this website.

  3. Types of information collected on the Spark website

  4. There are two types of information collected on the Music website and in the Spark app: Personal Information and Non-Personal Information.

    Personal Information

    Personal Information is information that identifies you as an individual, such as your name, mailing address, email address, age range, etc. Personal information is only obtained when you voluntarily provide the information to us. Spark uses personal information to better understand your needs and interests and to provide you with better service. For example, you may be asked to voluntarily submit your email address to us when communicating with us or your name and email address when entering a sweepstakes or contest.

    On occasion, Spark may ask you to voluntarily submit information about other people. For example, this may be done to send them a link to a web page or sign them up for a promotion.

    Once you choose to provide us with personal information, you can be assured it will be used only to support your relationship with Spark. We take seriously the trust you place in us and will not sell, rent or lease your personal information to others.

    Non-Personal Information

    Non-Personal Information is information that does not identify you as an individual, such as your browser type, IP Address, the URL of the previous website you visited, etc. Spark may automatically collect certain types of non-personal information from you when using the Spark website. We may also collect non-personal information that you voluntarily provide, such as information included in response to a questionnaire or survey.

    Purchase information

    Spark offers are facilitated through third party providers (LiveNation, Ticketmaster and other music industry partners). These third parties share information with us relating to Spark customers purchases. That information is held securely and we do not share that information with any other third parties. The information is solely used for profiling purposes and to enhance the marketing of offers and services to our customers.

  5. Why we collect your information

    • To facilitate your participation in promotions, announcements or offers of Spark and other organisations;
    • To conduct marketing activities and to conduct market research;
    • To contact you and send communications to you regarding promotions, announcements or offers relating to Spark.
  6. Spark's primary purpose in collecting personal information on the Music website and in the Events section of the Spark app is to provide you with a safe and efficient experience and to provide you with services and features that better meet your needs or requests.

    Spark will collect your personal information for the following purposes:

    Some of the personal information we collect is essential for us to be able to accurately identify who is using various Spark promotions and announcements and to communicate with you. Other types of personal information we collect help us to profile our customers and what their interests are.

    Information Collected Through You

    If you choose to use certain services or enter a sweepstakes or contest on the Music website or in the Spark app, we may require you to provide contact and identity information. Where possible, we indicate which fields are required and which fields are optional. If you choose not to use a particular service or feature or enter a sweepstakes or contest, you do not have to provide the contact or identity information it calls for.

    Non-Personal Information Collected Through Technology
    Cookies:

    The Music website may use cookie technology to improve your experience on the Music website and gather data for website statistical reporting. Cookie technology does not capture your individual email address or any personal information about you.

    A cookie is a small piece of information sent by a website that is saved on your hard disk by your computer's browser. It holds information a site may need to personalise your experience (i.e., rotating images on the Music website home page) and gathers website statistical data, such as which pages are visited, what is downloaded, the Internet provider's domain name and country that our visitors come from and the addresses of sites visited immediately before and after coming to the Music website. However, none of this is associated with you as an individual and is measured only in aggregate.

    To browse without cookies, you can configure your browser to reject all cookies or to notify you when a cookie is set. (Each browser is different, so check the "Help" menu of your browser to learn how to change your cookie preferences.) Your experience of the Spark site may be different if you set your browser to block cookies.

    Web Beacons:

    The Music website may use web beacons to serve advertising, enhance email advertising and track usage on the Music website. We use third parties to manage web beacons and the data they collect. Web beacons do not capture your individual email address or any other personal information.

    Web beacons, also called clear GIFs (a common format for image files), are invisible files on web pages that you visit. If you visit a page on the Music website that contains a web beacon, it communicates with your computer to determine, among other things, whether you have been to that page before or viewed a particular advertisement.

    IP Address:

    The Music website may collect IP addresses for the purposes of systems administration, server problem diagnosis and compiling aggregate information (such as how many visitors logged on to the Spark Music website). When you visit a particular web page on the Music website, our servers log your IP address. An IP address is a number that is assigned to your computer automatically when you use the Internet.

  9. Who we share information with

  10. We take seriously the trust you place in us and will not sell, rent or lease your information to others.

    Spark employs other companies and individuals ("agents") to perform services on behalf of Spark, such as administering sweepstakes and contests, sending emails, providing marketing assistance, website management, data hosting and analysing data. Such agents will have access to personal and non-personal information only as necessary to perform their services for us and are not permitted to use it for any other purpose. In order to share information with our agents, Spark may transfer your personal information overseas to its agents to provide services to you.

    Spark may also work with other companies ("partners") to provide co-branded services or promotions. To provide a co-branded service to you, it may be necessary for us to share your personal information with our partners. The partner will only be able to use the information as necessary to perform the requested service or in aggregate form for statistical reporting.

    Spark may further transfer your personal information overseas to its agents and partners to enable Spark to provide services, announcements and promotions to you.

    Remember, if you go to other websites, including those of our partners, advertisers, merchants and other sites that link to our site, those other sites may collect personal and non-personal information about you. The information practices of those other sites are not covered by this Privacy Policy. We have no liability or responsibility for those sites or their own policies.

    Disclosure of personal information for legal purposes and protection of Spark and others: Spark reserves the right to share your personal information with third parties if we believe such action is necessary in order to: (a) conform with the requirements of the law or to comply with legal process served upon us; (b) protect or defend our legal rights or property, Spark or our users; or (c) investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person or violations of the terms and conditions of using the Spark website.

  11. Your choices and opting out

  12. By participating in Spark Music pre-sales competitions, S @ Spark Arena and other music promotions and experiences you'll receive Spark Music updates by email or SMS. You can choose to stop receiving this email at any time. Simply follow the instructions included in your email or send a reply stating your request.

    At any time, you can "opt-out" of receiving direct mail and marketing material from Spark, such as product and service updates, by following the instructions included in your email or by sending a reply stating your request, and we will make the requested changes.

  13. How to access and correct your personal information

  14. You may, in most circumstances, have access to personal information which Spark holds about you.

    To modify or delete your personal information, simply follow the instructions included in your email or on the Spark website, or send a reply stating your request, and we will make the requested changes.

  15. Children's privacy

  16. The Music website and Spark app is not intended for use by children. We do not knowingly collect information from children under the age of 13. If we learn that personal information on a child under the age of 13 is collected, we will delete that information from our systems. We encourage parents and guardians to be familiar with the websites that their children visit.

  17. Keeping your information secure

  18. The security of your personal information is very important to us, and we are committed to protecting the information that we collect. We have security measures in place at our facilities to protect against the loss, misuse or alteration of information that Spark has collected from you at our website.

    Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100 percent secure. As a result, while we strive to protect your personal information, Spark cannot ensure or warrant the security of any information you transmit to us or from our online products or services, and you do so at your own risk.

  19. Acceptance of policy

By visiting the Music website or the Events section of the Spark app, you are accepting the terms and conditions of this Privacy Policy, and we have the right to use your information as described in this Privacy Policy. We reserve the right to modify this Privacy Policy at any time. Your continued use of the Music website after we either personally notify you or generally post such changes on the Music website will constitute your acceptance of those changes.

    This Privacy Policy applies only with respect to the information that we collect on the Music website and not to any information that Spark collects through other methods or sources.

    If for some reason you believe that Spark has not adhered to this Privacy Policy, please notify us at one of the addresses below.

  22. Spark may modify or amend this Privacy Policy from time to time. In an effort to keep you informed of changes to this Privacy Policy, please note that the latest revision occurred in July 2017. Changes to this Privacy Policy will not affect our use of previously provided personal information.

  24. Please note that whenever you submit any information to us in connection with any Music-related services, you consent to Spark's processing of this information as necessary to provide the services in which you are participating.
