Effective 8th May 2018

These Terms and Conditions apply to the fixed term agreement for a phone term entered into between you and Spark New Zealand Limited (“Spark”). They apply in addition to Spark’s standard terms and conditions for the supply of phone and service. All of these terms and conditions comprise the Agreement with you.


Promotional offer Terms:

43 inch Smart TV available to new or existing Spark mobile customers purchasing a new Samsung Galaxy S9 or S9+ with a Spark Pay Monthly Open Term plan that is $59 or higher and in conjunction with 24 month interest free payments. $300 exit fee applies if you exit or disconnect from Spark in the first 3 months. This offer is for a limited time but may be subject to change or expiry without prior notice at Spark’s sole discretion. We can decide whether or not to accept any application and credit criteria may apply. Offer limited to one TV for each customer’s account. Shipment could take up to 4 weeks and TV must be shipped to a physical address. Spark will fulfil its obligation to help manage returns/repairs in the event the TV is damaged.


Interest Free Payment Terms:

On 24 month plans early termination charges and/or repayment of some of the phone subsidy may apply if your fixed term contract ends early. Phone subsidy available until further notice. Spark can withdraw this at any time.


Samsung Goods Returns policy:
A. GOODS RETURN POLICY
Samsung acknowledges the need for a product return for legitimate reasons. Outlined below are some of the reasons for requesting Product Return from Samsung.

1. ‘Stock Rotation’ or Return of A-Grade Product
It is the policy of Samsung not to approve or accept return of A-grade goods (ie where the end user customer rejects goods that are in good working order for no reason).

2. Transport Damage
If a consignment appears to have been damaged in transit, it should not be accepted. Please refer to Courier Post Terms and Conditions for returns process in this instance.

3. Concealed Damage
In respect of Products where the packaging shows no signs of damage but are found to have physical damage when unpacked, the customer will inform Samsung within 14 days of the date of delivery to seek collection of the Product by Samsung.

All concealed damage return request must include the following:

a) the serial number of the Samsung Products;
b) the serial number of the box
c) all original packaging, accessories and items within the box are returned.
d) photographs showing the damaged area of the Products; and
e) photographs showing all sides of the box and the area of the box corresponding to the damaged area of the Samsung Products.

Samsung may reject claims where there is evidence (damage to the box or signs or warping of the box) that the damage is the customer’s fault.

4. Return of Packaging, Manuals, Documentation and Accessories
All Products should be returned in their original packaging or in packaging suitable to prevent damage to the Products. Samsung will not accept responsibility for any additional damage to the Products that occurs during the return transport as a result of any unsuitable or inadequate packaging.

All items such as manuals, diskettes, CDs, digital media, and other accessories/documentation must also be returned with the Products and, whenever possible, be included in the original packaging. If any of those items are not returned the claim may be rejected and Samsung reserves the right to charge the customer for their replacement value.

5. Early Life Failure / Faulty Goods

5.1 Within 14 days -

In respect of early life failure / faulty Samsung Product sold to a customer by Spark, the customer must inform Samsung within 14 days from the date of delivery of such a fault. Samsung reserves the right to verify that the early life failure as genuine, once Samsung receives the Product.

No Samsung Product shall be eligible for an Early Life Failure claim where any panel shows more than 336 hours of use, early life failure will not be accepted.

Proof of promotion acceptance (i.e. the customer’s contract with Spark) by the end user from Spark must be supplied as part of documentation for claim return.

Any Product not returned to Samsung Returns within 30 days of delivery to end user will be rejected for direct replacement or credit.

5.2 Outside 14 days –

In respect of Samsung Products which fail after 14 days following delivery to the customer, the customer must inform Samsung who will advise the customer to seek a warranty claim. Samsung may request that the relevant Samsung Product is returned to Samsung or to an Authorized Service Centre for repair.

If the goods are not repairable, a claim can be made to Samsung, but must be accompanied by service centre report as documented proof.

6. Consumer Guarantees Act
Nothing in this section A is intended to exclude, restrict or modify a consumer's rights under the Consumer Guarantees Act 1993. This section A must be read subject to those statutory provisions and will not affect any statutory rights that a claimant may have in relation to the return of a Samsung Product.

A. GOODS RETURN POLICY

  • Unless otherwise specified, the benefits conferred by warranties set out herein are additional to all other conditions, warranties, guarantees, rights and remedies expressed or implied by any New Zealand legislation.
  • When a request has been approved, Samsung will notify the customer by issuing a Return Approval Notification. The customer will then book collection of the goods with the Samsung approved transport provider (at Samsung’s cost). See details within the Approval Notification document.
  • Please allow 5 working days to have the goods collected or receive written advice on rejection of the Returns Authority request from Samsung. If no confirmation is received within 5 working days, please contact Samsung on 0508 SAMSUNG (0508 726786) to inquire about the progress of your request.
  • The customer must return the Product within 10 days of receiving a Return Authority Number and must attach the Return Authority Notification on the Product when returning. It is the responsibility of the customer to arrange a pickup time with a Samsung nominated transport provider.
  • ALL Products being returned must be 100% complete and must be packaged in ORIGINAL PACKAGING with the Return Authority (RA) number clearly visible. All packing materials, manuals, diskettes, CDs, digital media, blank warranty cards and other accessories and documentation must be included in the original packaging, as provided by the manufacturer.
  • A return will not be processed, or a restocking fee may be charged in the event ANY material item(s) (ie remote) included in the original shipment to the customer is not present in the returned package. Items sent for return consideration will be immediately denied and Samsung return policy will NOT BE HONOURED in the event that a return shipment is received by Samsung improperly packaged, altered or physically damaged.
  • Courier Post Claim Process:

    In the event where the TV is damaged upon delivery the recipient will need to make a claim to Courier Post. The claim must be made within 7 days of receiving the damaged TV. Courier post will arrange retrieval of the TV. The TV must have ALL original packaging for Courier Post to undergo a damage assessment and thorough investigation.     Returns Process:

    Under our 7 day returns policy, we are happy to accept a TV return that meeting the following terms/conditions:

    - The TV was purchased within the promo period 8/05/18 – 5/06/18
    - The TV is in ‘new condition’ – all components are present including package with no scratches or damage.
    - Your proof of purchased must be included.
    - We will not provide any form or refund for this return.

    What do I do?

    1. 1. Complete the customer details and form sent to you
    1. Put the completed form, the TV and proof of purchase with the courier ticket
    3. Phone Courier Post 0800 268 7437 to arrange for the item to be collected. Once the parcel has been collected – you can track and trace with the number provided at courierpost.co.nz
    4. CourierPost will return the parcel to our warehouse. Our warehouse will check your TV is in good condition.

    What if I lose the courier ticket or change my mind?

    If you lose the bag, just call Spark at 0800 800 163 as soon as possible and we’ll send you a new one. Please let us know if you change your mind and decide to keep the TV.
