Terms and conditions for 5G Wireless Broadband Plan and 5G Wireless Broadband Netflix Plan / Offer Summary

When you sign up for Unplan Max Wireless Broadband (previously called 5G Wireless Broadband), we both agree to these Plan Terms. That includes any updates made along the way. Remember, it’s also a good idea to be across the General Terms – these apply to everyone using Spark services for personal use. The Mobile and Wireless Terms apply to you too.

Service Overview

Service Description

  1. Unplan Max Wireless is a broadband plan that flexes with you. Based on your usage each month, you are automatically moved between three price tiers. This means you have the freedom to use more data when you want to, and to save money when you use less data.
  2. With Unplan Max Wireless, you can choose to upgrade to Unplan Netflix Max Wireless.
  3. With Unplan Max Wireless, you can choose to add a landline.

  1. Unplan Max Wireless broadband  is not available in all areas. Take a look at the address checker to see what is available to you. Check your address

Service Charge

  1. The monthly price for Unplan Max Wireless is set out below.
  2. Your monthly charges will vary depending on how much data you’ve used. So whenever we invoice you for Unplan Max Wireless, it’ll be for the previous month’s usage.

Set Up Charge

  1. Set up charges will include a one-off $14.95 modem postage fee.

 

Access Type

  1. Your access type will be wireless. More information about access types and speeds can be found on the NZ Telecommunications Forum website.

Other Information

Minimum Contract Period

  1. Unplan Max Wireless has no minimum fixed term.

 

Notice Period (cancellation)

  1. You’ll need to give us 30 days’ notice to end your Plan. This is covered in more detail in our General Terms.

 

Traffic Management 

  1. We might have to pause, restrict, end or slow performance of your service if it’s necessary for us to protect our networks or manage traffic over our networks. We’ve covered this at clause 6.6 of our General Terms
  2. A Fair Use Policy applies to this plan. This means you cannot use the service in a way that is overly excessive or unreasonable. This policy is based on how most people use the service and helps us make sure everyone using it gets to enjoy it. If you engage in overly excessive or unreasonable usage, we will contact you. If this usage continues, you will be given the choice to move to fibre or a new plan.
  3. If you consider that the change a new plan under clause 14 has a negative impact on you or your use of the service (or new service) you can exercise your right to terminate the service and no notice period fee will apply.

Fair Use

  1. You need to use our services fairly – we’ve set out our rules on this at clause 2.6 of our General Terms

Effects on Other Services

  1. Your modem requires mains power. So, if there’s a power cut your broadband service won’t be available and you won’t be able to use it to contact emergency services. Make sure you have a charged mobile phone handy to use in a power cut in case of emergency. If you have existing services you’re planning to use with your broadband connection, you should check with the provider of those services to make sure they’ll work. This could include medical alerts, monitored home alarms, and interactive features of SKY TV. Take care to advise your service provider that your broadband service is delivered over wireless broadband (5G) technology to ensure their service is compatible with wireless technology.
  2. If you want to make calls from a landline (including 111 calls), you'll need to sign up for Unplan Max Wireless with a landline. Your landline will run over wireless.
  3. If you've ordered Unplan Max Wireless with a landline, it's possible your existing landline will be disconnected for a few hours when your Unplan Max Wireless connection is set up.

Other Charges

  1. You can choose to add a landline to your Unplan Max Wireless broadband. Your local calls are free. We do charge for national, international and mobile calls, but have a range of calling plans to suit most people. All your national and international calls will be provided and invoiced by Spark.

  1. When you sign up to Unplan Netflix Max Wireless, you will receive:
    1. Netflix Standard (Full HD) Streaming Plan for the duration of your Unplan Netflix Max Wireless service.
