Spark Game Arena Live terms and conditions

• Morning Session: The morning session will be held from 9am to 2pm. Doors for morning session ticket holders will open at 9am. Morning Session ticket holders must vacate the Arena by 2pm. The morning session is designed for families. Individuals 14 years of age and under must be accompanied by a parent, guardian or adult whānau member. Child tickets are available for the morning session for kids aged 14 and under.

• Evening Session: The evening session will be held from 3pm to 8pm. It's restricted to people aged 16 years and over. Doors for evening session ticket holders will open at 3pm.  Evening session ticket holders must vacate the Arena by 8pm. Ticket holders must present valid ID to enter the Evening Session. IDs will be checked by Spark Arena staff. Acceptable IDs are: NZ or other nationality official passport, NZ drivers licence, NZ 18+ Card/Kiwi Access Card or other NZ photo ID that includes date of birth. School photo IDs which display date of birth will be accepted for entry to the Arena.  Spark Arena staff will make the final decision on whether to admit attendees. Spark Arena’s ID policies as set out in Spark Arena’s Conditions of Entry (https://www.sparkarena.co.nz/conditions) will apply to the purchase and consumption of alcohol.
  

• All-day Session: Ticket holders may enter Spark Arena during both sessions, but will need to leave the Arena during the reset period between 2pm and 3pm. The all-day session is restricted to people aged 16 years and over. Ticketholders with an all-day session ticket will have their photo ID checked upon arrival to the morning session. IDs will be checked by Spark Arena staff. Acceptable IDs are: NZ or other nationality official passport, NZ drivers licence, and/or other NZ photo ID that includes date of birth. School photo IDs which display date of birth will be accepted for entry to the Arena.  Spark Arena staff will make the final decision on whether to admit attendees. Spark Arena’s ID policies as set out in Spark Arena’s Conditions of Entry (https://www.sparkarena.co.nz/conditions) will apply to the purchase and consumption of alcohol.
  

Tickets are sold through the Universe platform. Please refer to the Universe ticketing terms for more information. Universe is the exclusive seller of valid tickets. If you don't purchase your ticket through Universe, it may not be valid.

Changes to Spark Game Arena Live 

Line up: The line-up for Spark Game Arena Live is subject to change, which may include adding, withdrawing or substituting the content of the day, such as brands, games, speakers and talent featured, or rescheduling the timing or order of sequence during the day.  If we make any changes to the advertised line up, we'll notify anyone who's purchased tickets as soon as reasonably possible.

Changes to these terms: Without limiting any rights you have under these terms or the Universe terms, we may need to make a change to these terms. If that change will disadvantage anyone who's purchased tickets, we'll notify you as soon as reasonably possible. We’ll act in good faith and be fair when we’re deciding if a change will disadvantage you.

Privacy

When you buy tickets to Spark Game Arena and attend the event, we may collect personal information about you. This may include things like your ticket purchase details, interactions we have with you about the event and information about your use of our online platforms as part of your event experience. We’ll manage your personal information in line with our Spark Privacy Policy.

Photography and recording

By attending Spark Game Arena Live, you agree that your image, likeness, or voice may be used as part of any photograph or recording of the event for archival or commercial purposes. This photography or recording may be carried out by Spark, Spark Arena and/or other event sponsors and partners. 

Spark may use your name, likeness, and/or voice collected as part of this for Spark’s publicity purposes. This includes Spark’s website, direct and social media channels and public relations.

Spark Game Arena Live Event Profile

Ticket holders will have the opportunity to create a Spark Game Arena Live profile (Profile) several weeks before the event. The Profile will be linked to the participant’s RFID wristband on the day.

The Profile will enable the user to earn points and prizes by participating in activities at the event. Participants can opt-out of using the Profile if they don't wish to participate in this component of the event.

Liability

Nothing in this section affects any rights you have under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, except if you are “in trade” and purchasing tickets for “in trade” purposes, you agree that the Consumer Guarantees Act 1993 doesn't apply to you and this is fair and reasonable.

Your liability to us: You accept liability to us for breach of these terms. You aren't liable to us for any loss to the extent that loss is caused by us.

Spark’s liability to you: we accept our liability to you for breach of these terms, for our breach of the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. We aren't liable for any loss to you to the extent that it is caused by you, or for any reason beyond our reasonable control (including third parties that we don't control); or for any indirect or consequential loss, or for any loss of profits, revenue, data, business, goodwill or savings.

We each agree to take reasonable steps to avoid or minimise any loss we suffer in connection with Spark Game Arena Live tickets or the event.

Limits on liability

Subject to the liability section above, our liability to each other for breach of contract, negligence or other circumstances arising out of or in connection with these terms is limited to the Transaction Value of the tickets purchased. This is the maximum amount payable (not the amount automatically payable if one of us does something wrong). To best assist us in helping you with any claim for loss, please contact us promptly after becoming aware of your claim, and if possible, within six months after becoming aware.

The limit outlined in the paragraph above doesn't apply when it comes to any loss or damage caused by you or us for fraud, willful breach or willful damage.

Spark Game Arena Live Code of Conduct

We want those who experience Spark Game Arena Live to have fun and stay safe so we require you to meet the Spark Game Arena Code of Conduct.

Be Respectful: You must be respectful and courteous of our representatives and other users and players at Spark Game Arena Live at all times.

If you are sick, please stay home: Please consider the health and wellbeing of others before attending this event. If you are feeling unwell and have any cold or flu-like symptoms or Covid-19, or you have been in contact with anyone that has, please stay home. We will not be refunding tickets if you are sick. We suggest you donate your ticket to a friend or family member if you can’t make it. You can have your ticket transferred to someone else by accessing your Universe account. Spark Arena may implement pandemic and health measures in relation to the Arena.

Comply with the law: You must respect all applicable New Zealand laws while attending Spark Game Arena Live.

No acts or threats of physical violence: We understand that some gameplay experiences may include elements of violence, but we won't tolerate acts or threats of physical violence seriously. This includes but isn't limited to doing, threatening or encouraging any of the following things:

• Physical/verbal harm or abuse to any person
• Malicious or unauthorised disclosure of any person’s real name, contact details or other personal information
• Self-harm or other activity likely to cause serious injury or death

If we’re concerned about the safety of any person, we may contact Police or Emergency Services or take other reasonable steps. We reserve the right to ask you to leave the Arena if you display any behaviour that breaches the Code of Conduct.

No bullying, harassing or abusive content or behaviour: Hateful, bullying, harassing and abusive content and behaviour is prohibited in the Spark Game Arena Live event. This includes doing, threatening or encouraging any of the following things:

• Discrimination, bullying, abuse, harassment or sexual harassment based on any person’s characteristics such as race, ethnicity, age, religion, sex, gender, gender identity, sexual orientation and disability
• Using or configuring your username, gamertag or any part of your Spark Game Arena Live Profile in a way that's harmful, defamatory or offensive
• Spam, scams and other unacceptable conduct

Reporting

If you experience any behaviour that you believe doesn't adhere to the Spark Game Arena Live Terms, Code of Conduct, or have any other concerns, you can raise it with a crew member at Spark Game Arena Live. Your identity will be protected, and the person won’t know you reported them. We’ll work to address the problematic behaviour once we’re aware of it.

Breaches

We reserve the right to ask you to leave the Arena if you display any behaviour that breaches the Code of Conduct.

Game Terms and Conditions

You must comply with the game publisher’s terms and conditions when you play or participate in any games available at Spark Game Arena Live. We'll keep updating this section with new terms and conditions as we add further games to the Spark Game Arena Live line-up.

This event isn't sponsored, endorsed or administered by Epic Games. By participating in this event, to the extent permitted by applicable law, players agree to release and hold harmless Epic Games Inc, its licensors, its and their affiliates and its and their employees, officers, directors, agents, contractors, action, losses, liabilities and expenses related to the event.

This event is in no way sponsored, endorsed or administered by or otherwise associated with Mediatonic Limited. The information players provide in connection with this event is being provided to the event organiser and not to Mediatonic Limited. By participating in this event, to the extent permitted by applicable law, players agree to release and hold harmless Mediatonic Limited, its licensors, its and their parent companies and affiliates and its and their employees, officers, directors, agents, contractors and other representatives from all claims, demands, actions, losses, liabilities and expenses related to the event.

Resolving Disagreements

If you have a concern or complaint to make about Spark Game Arena Live or these terms, please get in touch with us first at sgalive@spark.co.nz so we can do our best to try and resolve things for you.

Spark will use reasonable endeavours to consult or negotiate in good faith and attempt to reach a just and equitable settlement that's satisfactory to you and Spark.

The above doesn't restrict your legal rights, including under applicable consumer law, to make a complaint to the appropriate regulatory authority, or your right to pursue court or tribunal proceedings or other forms of settlement with the aim of resolving your concern or complaint.

General

Governing Law: These terms are governed by New Zealand Law. New Zealand courts will have exclusive jurisdiction over any dispute arising under these terms.

Transfers: You can’t transfer your responsibilities under these terms to anyone else unless we agree to it. We may transfer some or all of our rights or responsibilities under these terms to someone else and we may not need you to agree before we do so. If this change disadvantages you, we'll comply with our obligations set out in the “Changes” section of these terms.

Severability: Each term of these terms is separately binding. If for any reason a term isn’t legally effective, all other terms will still be binding and we can replace the ineffective term with one of similar meaning that’s lawful and effective.

Waiver. If either of us fail or are slow to enforce any rights or power we have under these terms, it won’t mean we’re waiving those rights or power. And if either of us decides to waive any breach of the terms, it won’t mean we’re waiving any other or subsequent breaches.

From time to time, we may send you sales and marketing information about Spark Game Arena updates and events. You can let us know at any time if you don't want to receive sales and marketing information by contacting us. You agree that the sales and marketing information we send electronically doesn't need to include an unsubscribe facility.
