1.1. These Business Share Plans Terms are one of our Plan and Product Terms and apply when you sign up for or use the Business Share Plans. In buying these services, you understand and agree to these terms. They also apply to any use of the Business Share Plans by your staff or anyone else you have authorised. If anyone in your business will be using the Business Share Plans, please ensure they have also read and understood these terms. Our Business General Terms and Business Mobile and Wireless Terms also apply to these products and services.

1.2. In the event of inconsistency, these Business Share Plans Terms take precedence, followed by the Business Mobile and Wireless Terms then the Business General Terms.
3.1. Business Share plans are shared data pools that allow sharing of mobile data with users in your account which can be managed by an administrator.
3.2. Users must be on a specific sharer plan and be under the same customer account to use the shared data pool.
3.3. Shared data is for New Zealand mobile data use only. Roaming rates and/or roaming packs will be applicable for users when roaming.
Base data
3.4. Each Business Share data plan begins with a set amount of shared base data.
Extra data
3.5. Extra data is automatically added to the shared data pool when the initial amount of shared data has been used. This means users still have mobile data to use.
3.6. These will be added in fixed data blocks as shown in the table below. They will be charged to your account at a flat rate per data block
3.7. Each Business Share plan will have extra data added in a specific data block.
3.8. Each billing month the plan will start with the same amount of base data. Any extra data that hasn't been used will remain available for the following billing period.
3.9. Unused base data does not carry over to the following month.

3.10. To help you manage how much extra data is added to the base data, you can use smart caps.
3.11. A smart cap can be set on your Business Share Plan to allow the highest dollar value of extra data to be added. Administrators can set these through MySpark online or in the app.
Shared data controls
3.12. Shared data controls help manage how much shared data each user uses. Administrators will be able to view and manage the shared data of users they are sharing with.
3.13. This can be done through MySpark online or in the app, or the MySpark Business portal.
3.14. Both MySpark online or the app will give a view of shared data usage for each user that is using the shared data.
3.15. Usage information will reset at the beginning of each bill period. Usage is rated from our network and is updated near real time to our best efforts. You remain responsible for all charges in the event of any delays to usage.
3.16. Usage is calculated in 10KB amounts and will be shown in 0.05GB amounts for display purposes. Details of visited sites won't be shown as part of monitoring usage.
Setting limits for your users
3.17. Management of shared data limits, and use of that data, is the responsibility of the customer. We won't proactively ensure the limits you've set allow your plan to be maximised, or all the data within your plan’s allocation to be used.
3.18. You can set the highest amount of shared data a user can use within a billing period. Shared data usage is first come, first serve. Setting a limit will not mean that a user can use all the data in their limit, as other users in the group may use up the total shared data pool, or a smart cap on the pool may be applied before that sharer reaches their limit.
3.19. Once a user reaches their shared data limit, they won’t be able to use any more shared data for the rest of the billing period.
3.20. We'll send a notification to the user when they reach the limit set by the administrator.
3.21. An administrator will need to either increase or remove the shared data limit so the user can continue to use data. Alternatively, a user may choose to buy an individual data allowance provided no account restrictions apply. For example, a customer may request a self-service bar is placed on an account which would restrict users from buying extra data via MySpark, online or in the app.
3.22. It's also possible to stop a user from using shared data by setting the limit to zero.
3.23. Any limit set will stay unless it's changed.
4.1. To use data from the Business Share Data Plans, you'll need to be on one of our Business Sharer Plans.
Contract term option
4.2. You can choose to have a 24-month minimum term on the Business Sharer Plans.
Open term contract
4.3. An open term contract is a contract with no fixed term and is available on Business Sharer and Business Mobile Plans.
Data Only Business Sharers
4.4. Data Only Business Sharers can be used on devices such as tablets. These are blocked from any voice or text usage and only have access to shared data. If you request this block to be removed, voice and text usage will be charged at casual rates.
Call charges
4.5. The lowest call charge for your Business Sharer Plan is one minute, except for the following:
4.6. After the first minute you pay per minute.
4.7. Every call you make is charged at the rate applicable to your Business Share Plan. If there's no answer you won't be charged for the call.
Note: Calls answered by a message service or answering machine are chargeable.
Included minutes
4.8. Business Sharer Plans include unlimited or all you need minutes. Unlimited talk is for standard calls to standard New Zealand and Australian numbers.
4.9. This excludes premium and special numbers.
4.10. Unlimited minutes can't be used for the following:
4.11. If we think that your usage is non-standard personal usage we may contact you and ask you to stop. If the continues despite notification from us, we may remove your Business Mobile Plan with unlimited minutes immediately with notice.
4.12. Included anytime minutes can be used any time of the week, at any time of the day.
4.13. Included minutes only apply to your applicable national or Australia voice call rate depending on your plan entitlement.
4.14. If your included voice calling minute allocation expires during a call, the rest of the call will be charged at the overage rate that applies to your chosen plan. For example, if there are two minutes remaining at the start of your call and that call lasts for 30 minutes, the call will be charged at the overage rate for 28 minutes.
Excluded minutes
4.15. Excluded minutes are any of the following:
Operator assisted calls
4.16. You'll be charged the full minute rate for each minute or part minute.
Premium numbers
4.17. You'll be charged both the premium number rate and the mobile rate for each minute or part minute.
Voicemail/cellular secretary/executive secretary
4.18. Any number of messages may be checked per access.
Video calling
4.19. Only available to other Spark mobiles capable of video calling within New Zealand, or video capable mobiles on a supported international mobile network in a video capable coverage area.
Included Texts
4.20. Each Business Sharer Plan includes an unlimited amount of national person to person text messages per month.
4.21. Unlimited text is for texts to standard New Zealand and Australian numbers. This excludes premium and special numbers. Unlimited text can't be used for prohibited usage. If we think you're engaging in prohibited usage we may contact you and ask you to stop. If it continues despite notification from us, we may remove your Business Sharer Plan with unlimited texts immediately with notice.

4.22. Users on a Business Sharer Plan won't receive an individual allocation of data, they'll instead have access to a shared data pool via the Business Share Data Plans.

Free voicemail for business
4.24. Free voicemail on Business Sharer Plans is only available to business customers. Applies to calls to voicemail while in NZ only.
Free landline on mobile
4.25. Free landline on mobile on Business Sharer Plans is only available to business customers.
5. Plan transfer
5.1. Pay Monthly customers who have a minimum term and want to move to an open term plan will have to pay disconnection fees before connecting to an open term plan. Pay Monthly customers who are on a minimum term wishing to change their postpaid plan to one which is lower than their current plan can do so at any time, but transfer charges may apply. 5.2. You may transfer plans only once per billing period by calling us on 126.
