The following Terms apply to our customers who have a Business Wireless Broadband service with us. These Terms apply together with the Business Mobile Postpaid Agreement. These Terms will prevail to the extent they are inconsistent with the Business Mobile Postpaid Agreement.
- Business Wireless Broadband requires a Spark Wireless Broadband Modem.
- Spark does not guarantee that the service can be supplied at a particular location.
- If your Business Wireless Broadband service is disconnected for any reason, we cannot guarantee you will be able to connect back to a fixed line broadband service, particularly if there are capacity issues in your area. If you have an existing broadband connection with another provider, you are responsible for arranging for disconnection of this service.
- Spark Wireless Broadband is only available in certain 4G coverage areas. 4G coverage is not available everywhere.
- The Spark Wireless Broadband Modem contains a SIM card. You may not use this SIM card in any other device. It remains our property and you must return it to Spark on reasonable request.
- You may not use your Spark Wireless Broadband Modem to receive the Spark Wireless Broadband service at any other location other than the installed location. If you are moving, please contact us. If you are moving to a location within our Spark Wireless Broadband coverage area, you may be able to continue to use the service. If you are moving to a location outside our current Spark Wireless Broadband coverage area, you will need to end your contract with us. Early termination charges may apply.
- If we become aware that you are using your Spark Wireless Broadband Modem at a location other than the installed location we reserve the right to withhold, suspend, disconnect, or restrict your Business Wireless Broadband service without notice. However, wherever possible we will try to contact you before we take any action. The reason we retain this right is that we need to be able to manage the network to ensure that all customers using the network receive a reliable and consistent service.
- The Spark Wireless Broadband Modem requires mains power. In the event of a power failure, service will not be available, including access to emergency services.
- If your Business Wireless Broadband has a 24 month minimum contract period, and your service is disconnected before the completion of that minimum contract period, you will be charged an early termination fee of $199. You will not be required to pay an early termination fee if you are exercising your right to terminate your agreement with us under clauses 15.2, 15.4 or 15.8 of the Business Mobile Postpaid Agreement.
- If your Business Wireless Broadband has a 24 month minimum contract period, you can switch between other Business Wireless Broadband contract plans and continue with your original term contract period. The contract start date and period do not alter. However, if you switch to a Business Broadband plan that is on a different technology, an early termination fee may apply if you're still within your minimum term contract period.
- If you sign up to a Business Wireless Broadband from 16 November 2020, you will not have a minimum contract period but you will need to purchase a Spark Wireless Broadband Modem from Spark, or supply your own Spark Wireless Broadband Modem.
- If you supply your own Spark Wireless Broadband Modem, it must meet any minimum modem specifications to enable you to receive the full benefit of your Business Wireless Broadband service.
- Your Spark Wireless Broadband Modem may not be suitable for other Spark broadband services or other service providers’ services.
- Charging for Business Wireless Broadband starts once your service is connected to our network. Please be aware you need to let us know 30 days in advance if you wish to cancel this service (these services). If you change or remove your plan or package within 30 days you will still be charged for the full month.
- If you choose to change to another broadband technology (e.g. ADSL), an availability check will need to be done for your address. Spark does not guarantee availability of an alternative broadband technology at your address. You may also need to purchase a new modem that is compatible with the alternative technology type.
- Any unused data within a monthly data allocation will not be carried forward to the following month.
- The Business Wireless Broadband service is not able to be used as a gateway server.
- Upstream and downstream speeds are based on a theoretical maximum, and actual speeds will be affected by various factors including NZ and overseas networks, your modem and computer technology, internal home wiring and other environmental factors.
Business Wireless Broadband with Landline only
- For Business Wireless Broadband with Landline, local calls are included in this plan.
- This service does not come with a copper phone line. This means that services that use a standard copper landline, such as some medical alerts, monitored home alarms, faxes, the interactive features of SKY digital or PABXs are incompatible with Business Wireless Broadband with Landline.
Business Flexible Broadband Plan
- We have a Fair Use Policy which applies to our Business Flexible Broadband Plan, and ensures ongoing access to Spark's Business Wireless Broadband service for all business customers by regulating Business Wireless Broadband use where we reasonably believe such use is excessive or unreasonable. We determine this Fair Use Policy by reference to our average business customer usage and our estimated typical business customer usage of our Business Wireless Broadband service. Use that excessively or unreasonably exceeds Spark's average business customer usage over any month will activate our Fair Use Policy. Where we reasonably believe your use is excessive or unreasonable, we may adopt the following process:
- Contact you to let you know that you have exceeded our usage limit following the first month of any excessive use.
- If your use of our services continues to be excessive or unreasonable, we will advise you that you may need to move to a new plan. Any new plan may have reduced speeds once you exceed a set data usage amount.
- If your use of our services continues to be excessive or unreasonable:
- We may need to suspend, modify or restrict your use of our services; or
- You will be moved to a new plan, which may include reduced speeds. We will tell you in advance when we do this and there will be no early termination fee or charges if you choose to exit when we move you to your new plan. We will also work with you to help reduce usage or finding another technology more suitable to your needs.
