Consumer Mobile Terms

The Spark Mobile Postpaid Agreement applies in addition to the following terms and conditions.

Contract term option

You can choose 24 month Minimum Term or No fixed term contract. The contract term applies to you, the account holder of the Share Plan. Disconnections Fees or repayment of the mobile subsidy may apply if your contract ends early (see Schedule of Disconnection Fees and Transfer Charges). Additional users ("sharers") can be added or removed from the Share Plan, at the account holder's discretion, without incurring early disconnection fees.

Eligibility

Available to customers on any Pay Monthly plan, with at least two Spark mobile numbers (one of which is used by a user) and who agree to have the charges incurred by these mobile numbers billed to the same account holder. The maximum number of sharers you can add to your account on each Share Plan is set out in the pricing information. All mobiles on the Share plan must be under one account with no other Spark products or services being billed to that same account.

Plan and other charges

As the account holder, you are responsible for all charges associated with the Share Plan. Charges include the minimum monthly charges, monthly additional user charges (for each sharer), overage charges, extra charges and any other service charges incurred. If you add a sharer to your Share Plan, you authorise that sharer to access and use the services. The charges for your Share Plan can be found in the pricing information.

The account holder must nominate one mobile number on the Share Plan as the primary mobile of the Share Plan ("the Primary Mobile"). The monthly subscription charge for the Share plan will be applied to the Primary Mobile. Each additional mobile number will incur a monthly share user fee as set out in the pricing information for your Share Plan. If the Primary Mobile of the plan is disconnected for any reason, another mobile number on your account must be nominated as the Primary Mobile and the same terms will apply to that mobile number. If you do not nominate a new Primary Mobile, Spark will select one for you.

The minimum call charge for your Plan is one minute except for operator assisted and 0900 calls or other premium numbers; after the first minute you pay per minute. Every call you make is charged at the rate applicable to your Share Plan. If there is no answer you won't be charged for the call (note, calls answered by a message service or answering machine are chargeable).

Included minutes

  • Each Planincludes minute allocations that can be used for calls to any New Zealand network
  • Some Plans may include unlimited or 'all you need minutes'. Unlimited talk is for standard person-to-person calls to standard NZ numbers (you need to be talking to another person). Excludes premium and special numbers. Unlimited minutes cannot be used for multiple simultaneous calling, re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialling, machine to machine communication (including by using your SIM card in any other device), Cellular Trunking Units (CTUs), or any other activity that Spark considers to be non standard personal usage ("Prohibited Usage"). If we consider that you are engaging in Prohibited Usage we may contact you and ask you to stop such usage. If such Prohibited Usage continues despite notification from us, we may remove your Ultra Mobile plan with unlimited minutes immediately with notice.
  • Some Plans include minute allocations that can be used for calls to Australian networks. See your specific Plan for details.
  • Included anytime minutes can be used any time of the week, at any time of the day
  • Included minutes only apply to your applicable national voice call rate
  • If your included national voice calling minute allocation expires during a call, the remainder of the call will be charged at the overage rate that applies to your chosen plan. For example, if there are two minutes remaining at the start of your call and that call lasts for 30 minutes, the call will be charged at the overage rate for 28 minutes
  • Included minutes are allocated per billing period. Your included minutes will be refreshed on the first day of each billing period and may not be carried over from one billing period to the next. To find out how many minutes you have left in your billing period cycle, call *333 from your mobile or go to http://m.Spark.co.nz/yt on your mobile
  • Your included minutes roll over on the same date each month, i.e. if your billing period starts on the 5th, your new included minutes allocation will also refresh during the 5th
  • Included minutes expire on termination of your contract and any unused minutes will be lost
  • Included minutes are shared across all users on the Share plan. If at the end of each billing period the combined usage on your Share Plan exceeds your included minutes, you will be charged for each extra minute used by each sharer at the overage rate that applies to your Share Plan

Shared Data Controls

You may choose to share the mobile data of any Pay Monthly Mobile Plan.

When sharing mobile data there will be a Primary Mobile that is sharing data with other users.

If the Primary Mobile of the plan is disconnected for any reason, another mobile number on your account must be nominated as the Primary Mobile and the same terms will apply to that mobile number.

If you do not nominate a new Primary Mobile, within 24 hours Spark will select one for you from one of your existing sharers.

The Primary Mobile will be put onto a plan that meets the current business rules to allow for number of remaining sharers.

The first mobile sharer added to the plan will be the mobile sharer will be selected, if no mobile sharer is available then a tablet sharer will be selected.

We will notify the account holder of this change via email. If an email address hasn’t been provided as a key contact, we will notify the new Primary Mobile via SMS.

You may contact us at any time to change the primary mobile.

Customers who choose to share their mobile data will be able to view and manage the Shared Data usage of users they are sharing with.

This can be accessed through the My Spark portal, accessed via our website or by using the Spark Mobile App

Usage:

Both My Spark portal and the Spark Mobile App will give a view of Shared Data usage for each line that is consuming Shared Data.

The Sharers usage will only show Shared Data usage.

This may be:

Any Shared Data from the lead plan, any Shared Data extras purchased on the lead plan, any casual data on the lead plan including Data Stretch if this applies to your plan Any individual usage won’t be shown here.

Usage will reset at the beginning of each bill cycle. Usage is rated from our network and near real time based off best effort.

Usage is calculated in 10KB increments and will be shown in 0.05GB increments for display purposes. Details of visited sites will not be shown as part of monitoring usage.

Setting limits:

You can set a maximum amount of Shared Data a user can access within a billing month. Shared Data usage is still first come, first serve. Setting a limit will not ensure a user can use their limit as other users may use the Shared Data.

Management of Shared Data limits is the responsibility of the Primary Mobile. Spark will not proactively ensure limits always allow your plan to be maximised, or within your plan allocation.

Managing users: If a limit has been set, a user won’t be able to use any more Shared Data for the remainder of their bill cycle

We will send a notification to the user once this happens.

A leader or administrator will need to either increase or remove the Shared Data limit so the user can continue to use data.

Alternatively a user may choose to purchase an individual data allowance if no account restrictions apply.

It will be possible for a leader or administrator to stop a user from using Shared Data.

Any limit set will remain until such time as you choose to either remove, or change them. This includes stopping a user from using Shared Data.
